المستخلص: جاءت الشريعة الإسلامية لأهداف وغايات معينة تنتهي أخيرا إلى تحقيق الاستخلاف، وقد نالت في سيرتها التاريخية البنائية اهتمام العلماء بحثا وتنظيرا وبيانا خصوصا الضوابط والمعايير الناظمة لصحة البناء وصلاحية الأداء، ويأتي هذا البحث كلبنة في إطار هذا المسعى لبيان هذه الخصوصية الضبطية في جانبي الاعتبار والاستثمار لأهميتها كأداة فعالة في مجابهة متطلبات الحياة الإسلامية في جميع ميادينها، وقد حاول الباحث - بعد تقديم مسرد دلالي لمفردات العنوان في مكونه الأول-، في مكونه الثاني جمع ضوابط المقاصد في جانب الاعتبار بدءا باستعراض آليات كشف مقاصد الشريعة المتمثل في مقاصد الخطاب الشرعي (الآليات الصريحة) ومقاصد الحكم الشرعي (الآليات غير الصريحة)، ومن ثم المزالق التي تكتنف عملية التقصيد الشرعي، وجاء مكونه الثالث في ضوابط استثمار المقاصد بعد كشف استتارها في المنظومة التشريعية على مستوى التأصيل (تقصيد الأصول والفروع) ولدقة هذا المسلك وحساسته في محددات الحراك ذكر (شروط المقصد وضوابط التقصيد)، والنماذج (مجالات الحياة) المحصورة على جهة الأولوية المتمثلة في البناء المعرفي، ونظرية الإصلاح السياسي/ السياسة الشرعية والفقه الدستوري وفق النظر المقاصدي، وهدف البحث إلى بناء منظومة مقاصد الشريعة على منهاج ضابط للاجتهاد في التأصيل والتنزيل، ومن ثم بناء واقع إنساني رشيد من خلالها، وكشف المحاولات الرديئة والمنحرفة في مسلكي التصور والتخلق، وسار البحث على منهج الوصف والتحليل والاستقصاء المحدود، مع الاستفادة من باقي المناهج في حدود ضيقة. واختتم بأهم النتائج المتوصل إليها وهي: أن للمقاصد بعدا حديا وبعدا وظيفيا حركيا كأداة اشتغال حضاري للأمة الوسط شهادة وعبادة وعمارة، وأن الضوابط تمثل مساطر استقامة للفهم والتنزيل، وتمنع الأهواء في الإجراء وأن إدراك مقررات العلماء حول آليات الكشف المقاصدي يتم عبر تقسيم المقاصد إلى مقاصد الخطاب الشرعي ومقاصد الحكم الشرعي، ومقاصد الشريعة، ومجال التقصيد يكون للفقه والأصول، وأهم أنموذج لهذا التقصيد البناء المعرفي والفقه السياسي الدستوري. وتتجه آفاق البحث للمطالبة لذوي الشأن بتجميع ضوابط المقاصد والتقصيد في معلمة، إضافة لتبني مشروع بناء العلوم وفق الفكر المقاصدي، وإيجاد شبكة تواصل لرصد الأطروحات والأبحاث المقاصدية في مؤسسات التعليم العربي والإسلامي للمطالعة والبناء المعرفي عليها.

Islamic law was sent to (achieve) certain goals and objectives that finally end in achieving the appointment of a successor. In its context of historical construction, it has received the attention of scholars in terms of research, authorization, and data, especially the regulations and standards governing the validity of construction and the validity of the performance. This research is a building block within the framework of this endeavor to demonstrate this control privacy in terms of consideration and investment for its importance as an effective tool in confronting the requirements of Islamic life in all its fields. The researcher, post presentation of a semantic glossary of the title's vocabulary in its first component, attempted to collect the controls of objectives in consideration in the second component, starting with reviewing the mechanisms for detecting the legitimate objectives of sharia, represented by the objectives of Legitimate speech (explicit mechanisms) and the objectives of Legitimate ruling (non-explicit mechanisms) and hence the obstacles surrounding the process of Legitimate objective. The third component deals with the objective investment controls after the disclosure of their secret in the legislative system at the rooting level (objective of ascendants and descendants). The accuracy of this course and its sensitivity in the determinants of movement, the (objective conditions and controls of making objective), and models (areas of life) limited to the priority area of knowledge building and the theory of political reform/legal policy and constitutional jurisprudence are mentioned according to the objective point of view. The research aims to build a system of objectives of sharia on an approach controlling diligence in rooting and revealing and hence build a rational human reality through it, and uncover the bad and deviant attempts in the behaviors of perception and creation. The research proceeded according to the methodology of description, analysis, and limited survey while benefiting from the rest of the curriculum to a narrow extent. The research concluded with the most important findings: that the objectives have a remote dimension and a functional and movement dimension as a tool of civilized work for the justly-balanced (Muslim) nation in terms of testifying, worship, and architecture. The controls underline the righteousness of understanding and revelation and prevent lusts from happening. The realization of the decisions taken by scholars about the mechanisms of objective detection is carried out by dividing the objectives into the objectives of Legitimate discourse, the objectives of Legitimate ruling, the objectives of Shariah, and the field of making an objective shall be for jurisprudence and principles of the jurisprudence. The most important example of this objective makis is cognitive building and constitutional political jurisprudence. The research horizons aim to ask the concerned people to compile the controls of objectives and objective making, in a guide, in addition to adopting a science building project according to the objective thought, and create a network of communication to monitor dissertations and theses in Arab and Islamic educational institutions for reading and knowledge building.
