الحمد لله والصلاة والسلام والصلاة على رسول الله وبعد: فهذا بحث موسوم بــ "منهجية السنة النبوية في التعامل مع مهددات السلم المدني. نظام العقوبات أنموذجا"، أعرض أقوال نبينا صلى الله عليه وسلم وأفعاله فيما يتعلق بنظام العقوبات، والتي كانت نبراسا يضيء عبر كل الأزمان لمن يبحث عن السلم والأمن والاستقرار. هذه الدراسة تحاول الإجابة على عدد من الأسئلة المتعلقة بالقواعد العامة التي اتبعتها السنة النبوية في التعامل مع مهددات السلم المدني، وكيف تعاملت مع الجريمة قبل وقوعها وحال وقوعها وبعد ذلك، ثم كيف احتاطت لمنع تطبيق نظام العقوبات تطبيقًا خاطئًا. وقد بينت في البحث مفهوم مصطلحات البحث، فذكرت مفهوم السنة وكذلك السلم المدني ثم العقوبات، ثم بدأت في المبحث الثاني بذكر منهجية السنة النبوية في التعامل مع مهددات السلم المدني من خلال نظام العقوبات، وذلك من خلال مطالب كان أولها في بيان السنة النبوية للقواعد العامة في التربية وتحقيق صلاح المجتمع، والمطلب الثاني تكلمت فيه عن سد كل ذريعة للجرائم التي تهدد السلم المدني، ثم كيف بينت السنة النبوية كثيرًا من أحكام العقوبات وشرائط إثباتها وإقامتها، وفي الرابع تناولت أعمال قاعدة العدل في العقوبات الشرعية، وكان المطلب الخامس حول حرص السنة النبوية على منع تطبيق نظام العقوبات تطبيقًا خاطئًا. أخيرًا ضمنت الخاتمة نتائج البحث وتوصياته، ثم مراجع البحث والموضوعات، فأحمد الله تعالى على ما أنعم وأكرم وأسأله أن يكون البحث عونا لطلبة العلم وطالباته في دعوتهم ونشرهم للخير في الأرض.
Alhamdullah, peace and blessings be upon the messenger of God Mohammad: In this study titled "Prophet's Sunnah Methodology in dealing with threats to civil peace … the penal system as a model", I present the sayings and actions of our Prophet, may God's prayers and peace be upon him, with regard to the penal system, which was a light that shines through all times for those looking for peace, security and stability. This study attempts to answer several questions related to the general rules followed by the Prophet's Sunnah in dealing with threats to civil peace, and how it dealt with the crime before it occurred, when it occurred and after that, and how it look precautions to prevent the wrong application of the penal system. In this first chapter, I explained the concept of search terminology, then mentioned the concept of the Sunnah, as well as civil peace, and then explained penalties. In the second chapter I began by mentioning the methodology of the Prophet's Sunnah in dealing with threats to civil peace through the penal system, through demands, the first of which was in the statement of the Prophet's Sunnah of the general rules in Education and achieving the righteousness of society, and then in the second section in which I discussed blocking every pretext for crimes that threaten civil peace, then how the Prophet's Sunnah showed many of the penal provisions and the conditions for proving and establishing them, and in the fourth section I dealt with the implementation of the rule of justice in sharia punishments, and the fifth section was about the keenness of the Prophet's Sunnah On preventing the wrong application of the penal system. Finally, In the conclusion I have included the results of the research and its recommendations, then the references of the research, so thank God for what has generously blessed, and I pray that this research would be a help to students in their calling and spreading the good on earth.
