|a الحج ركن من أركان الإسلام، وله أهمية كبيرة في حياة الفرد المسلم، وقد يعجز الإنسان عن أداء الحج بنفسه، فله أن يستنيب غيره، وقد عرفت الحج، ومشروعية النيابة فيه. وضوابط النيابة فيه وأحكامها. وشروط النائب والمنوب عنه. وذكرت هل للنائب أجرة أو نفقه، ومتى تخرج من رأس المال، ومتى تخرج من الثلث. وذكرت ما يلزم المستأجر من أحكام، وما عليه الالتزام يه. وحرصت على ذكر الأقوال الفقهية للمذاهب الإسلامية وأدلتها، ورجحت بعض الأقوال وأتبعت البحث بخاتمة.

|b Pilgrimage (Hajj) is one of the pillars of Islam. It has a great importance in the life of the Muslim individual. A person may not be capable to perform Pilgrimage rites by himself, so he/she has the right to appoint someone else to perform it on his/her behalf. In this study, I defined Hajj and the validity of doing Hajj by proxy. I also presented the conditions and rulings on pilgrimage by proxy (Hajj bil Niyaba) and the conditions related to the proxy and the person represented by proxy. Besides, I discussed whether the proxy has to be paid; showing when the amount is to be paid out of the represented person’s capital and from one-third of his/her property. Moreover, I mentioned the provisions related to the proxy and what he/she must abide by, with special focus on the jurisprudence statements of Islamic schools of thought and their evidences. Then I underscored some of these opinions. Finally, the research was followed by a conclusion.
