المستخلص: فرض المشرع المغربي على الصيادلة في أداء عملهم ومعالجة المرضى المحافظة على السر المهني، وجعله من التزاماتهم القانونية بعدما كان التزاما أخلاقياً. فالعلاقة بين الصيدلي والمريض تؤدي إلى الاطلاع على خصوصيات وأسرار المرضى التي يا يجب البوح بها إلا إذا كان مضطرا، لأنها أمانة لا يحق له الإفشاء بها دون إذن أو ضرورة، وذلك حفاظاً على شرف المريض وحماية لشخصيته، فأصبح انتهاك هذا الواجب جريمة مستقلة يعاقب كل يقترفها، وقد نظمها المشرع المغربي في قوانين خاصة وكذا المدونة الجنائية في الفصل 446 من القانون الجنائي المغربي، فجاءت هذه الدراسة للوقوف على كيفية تنظيم المشرع الجنائي المغربي جريمة إفشاء الصيدلي للسر المهني.

Le législateur marocain a imposé aux pharmaciens dans l'exercice de leur travail et le traitement des patients le secret professionnel, et en a fait l'une de leurs obligations légales après qu'il s'agissait d'une obligation éthique. La relation entre le pharmacien et le patient conduit à l’accès à la vie privée du patient et aux secrets que O doit être divulgués sauf s’il y est obligé, car c’est une fiducie qu’il n’a pas le droit de divulguer sans autorisation ni nécessité, et qui vise à préserver l’honneur du patient et à protéger sa personnalité, violer ce devoir est donc devenu un crime Quiconque le commet est puni et le legislature marocain l'a organisé en lois spéciales, ainsi que le code pénal de l'article 446 du Code pénal marocain. Cette étude a permis de découvrir comment le droit pénal marocain réglemente le délit de divulgation des secrets professionals des pharmacies.

The Moroccan legislature has imposed on pharmacists, while performing their work and treating patients, preserving professional secrecy and made it a legal obligation for them after being a moral obligation. The relationship between the pharmacist and the patient leads to the knowledge of the specifics and secrets of patients that should be not be investigated except in utmost necessity because it is a trust that he does not have the right to disclose without the permission or the necessity in order to preserve the honor of the patient and protect his personality. Therefore, violating this duty has become an independent crime, and anyone found committing it would be subjected to punishment. The Moroccan legislature regulates this crime in special laws as well as the Criminal Code in chapter 446 of the Moroccan Criminal Code.
