يعتبر المجتمع كصورة للجسد الذي يحتاج إلى الوقاية والحماية للمحافظة عليه، ومن المهم التذكير بأن تعريف القانون الجنائي يتم انطلاقا من علاقته بقيم المجتمع. ذلك أن الحيطة والحذر المطلوبين، أقوى في هذه الظرفية التي عرفت ظهور فيروس كوفيد 19 الذي أدى إلى تعطيل الحياة الطبيعية وعرقلتها. ومن الطبيعي أن الاخلالات بالنظم الموضوعة لحماية المجتمع في هذه الفترة بالذات يجب أن تعاقب وفق مقتضيات تتلاءم وخطورة وخصوصية الفعل الجرمي والمرحلة. وحيث أن تعقيد جائحة كوفيد 19 لا يمكن حصرها على المستوى الصحي فحسب، بل أيضاً تجاوزتها إلى الجانب القانوني وبالخصوص في المادة الجنائية، الشيء الذي يبرز النقاش حول الشرعية الجنائية والمخالفات غير العمدية في ظل جائحة كوفيد وعلاقتها بأزمة القانون الجنائي خصوصا على مستوى مبادئ المسئولية الجنائية. Le corps social a besoin de protection, de sauvegarde et de préservation, et il est opportun de rappeler que le droit pénal se définit par rapport aux valeurs d’une société. Parce que la prudence et la diligence requises sont plus fortes en ce temps de pandémie Covid-19, il est normal que les défaillances soient sanctionnées de manière à en faire ressortir la gravité toute particulière. La complexité du coronavirus ne se limite pas uniquement au niveau sanitaire mais elle le dépasse pour atteindre le niveau juridique et plus particulièrement la matière pénale. Society is considered as an image of the body that needs prevention and protection to preserve it. It is important to recall that the definition of criminal law is based on its relationship with the values of society. The required awareness and vigilance are stronger in this circumstance that knew the emergence of the COVID-19 virus, which disrupted and obstructed normal life. It is normal that breaches of the systems established to protect society in this particular period should be punished according to requirements that are appropriate to the gravity and specificity of the criminal act and the stage. Since the complexity of the COVID-19 pandemic can not only be limited to the health level but also bypass it to the legal aspect, especially in the criminal article, which highlights the debate on criminal legality and unintentional violations in light of the Covid pandemic and its relation to the criminal law crisis, especially at the level of the principles of criminal responsibility.
