المستخلص: تتطلب حماية البيئة بمختلف أطرها إجراءات سواء كانت وقائية أم ردعية، والتي تصب في مجملها في إطار قوانين حماية البيئة، ويعتبر نظام الرخص الإدارية العمرانية من أهم الوسائل الوقائية القبلية الفعالة لحماية البيئة كونها آلية مسبقة تحد من وقوع الاعتداء. كما يعتبر نظام الرخص الإدارية متعلقا بحريات الأفراد الخاصة في البناء وتشييد ما يرونه مناسبا في ممتلكاتهم أو ما هو من صلاحياتهم، وفي حقوق المجتمع في العيش في بيئة سليمة محمية، لإقامة توازن بين حق عام ومصلحة خاصة، والذي تمليه خصوصية وخطورة نظام الترخيص بصورة عامة والطبيعة الفنية والتقنية لمشاكل البيئة بصورة خاصة، والذي يبقي المستوى الميداني التطبيقي هو الفاصل في مدى نجاعة النصوص القانونية لحماية البيئة في مجال الرخص الإدارية.
