الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وأصحابه ومن والاه .. جمع علماؤنا الأفاضل الأحاديث التي قيل فيها بالنسخ في مصنفات خاصة باسم ناسخ الحديث ومنسوخه.. فهم اعتنوا بجمع تلك الأحاديث من غير أن يتعرضوا لنقد تلك المرويات وبيان سقيمها من صحيحها هذا من جانب، ومن جانب آخر لم يطبقوا الأحكام والقواعد الأصولية الخاصة برفع التعارض بين النصوص، وتركوا لأهل الاختصاص التمييز والتحقيق في بيان صحة وقوع النسخ أو عدمها. فمن بين هذه الأحاديث، ما ورد في الوضوء بعد الغسل، واعتبروه ضمن دائرة النسخ، وبسبب هذا اختلف الفقهاء في حكم الوضوء بعد الغسل على أقوال مختلفة. ونحن في هذه الدراسة نتحقق في ثبوت كل ما ورد من الأحاديث بهذا الشأن، ثم نبين هل تدخل هذه الأحاديث ضمن دائرة التعارض أو لا، فإذا قلنا بالتعارض هل من الصواب أن نلجأ إلى النسخ لرفعها أو غير ذلك من الطرق... ثم كيف يكون الرأي الفقهي بعد دفع هذا التعارض.. هذا وقد بينا أربعة مسائل فقهية وهي: حكم الوضوء قبل الغسل. والوضوء بعد الغسل. وتقديم غسل الرجلين وتأخيرهما. وأجزاء الغسل عن الوضوء. وبعد ذكر أراء الفقهاء وأدلتهم أخرجنا الراجح في كل مسألة منها مستعينين بالقواعد والضوابط الأصولية... واستعين الله تعالى في كل ذلك، وما توفيقي إلا بالله عليه توكلت وإليه أنيب...
All Praise is due to Allah, Lord of the Worlds, and prayers and peace be upon the Messenger of Allah, and on his family and companions and his followings. Our scholars have collected the traditions (ahaadeeth) in special works, in which they were said to be abrogated. They called these books as "abrogating and abrogated of the hadiths". And they take care to collect these traditions without criticizing it and without statement authenticity of hadiths from its weak. And they did not apply the fundamental rules and provisions for raising the discrepancy between the texts, and they left for the specialists distinguish and investigate the validity of the abrogation or not. Among these hadeeths, what is mentioned in wudoo 'after doing ghusl, and they considered it within the circle of abrogation, and because of this, the Jurists differed regarding the ruling on doing wudoo 'after doing ghusl on different sayings. In this study, we verify in all of the hadeeths are proven in this regard, and then we explain whether these hadiths are included within the circle of contradiction (conflict) or not. If we say contradictory, is it correct to resort to transcription or other methods for rising this? And then how is being the jurisprudential opinion after the pushing of this conflict.. We have shown four Juristic Issues which: -Ruling on doing ablution before ghusl .Ablution after ghusl-.Submitting of ghusl the legs and delaying them. - Sufficiency of ghusl without ablution. After mentioning, the views of the jurists and their evidence we took out the most correct in every issue using rules and fundamentalist basics...
