هذا البحث بعنوان (الحزم وأثره في العقوبات الشرعية ومدى مواءمته بين الحقوق الفردية والحقوق العامة) ويتكون من مقدمة وثلاثة مباحث في المبحث الأول تكلم الباحث فيه عن المصطلحات والتعاريف وفي المبحث الثاني تكلم فيه الباحث عن ماهية العقوبات المقررة في الشريعة، وبين فيه أن الشريعة قائمة على ركنين أساسيين، هما التيسير والحزم، ومن خلال التتبع والاستقراء وجد الباحث أن بالحزم تقل الجريمة وتضمحل، وأن في إقامة الحدود إقامة للدين، وصلاح للدنيا، وسعادة للأفراد، والمجتمعات، وفي المبحث الثالث بن فيه الباحث المواءمة والتوازن للحزم بين حق الفرد والمجتمع المبني على القاعدة المشهورة التي تقول (لا ضر ولا ضرار) وختم الباحث هذا البحث ببعض النتائج والتوصيات من أهمها: صلاح الشريعة الإسلامية لكل زمان ومكان لمواءمتها بين جميع الحقوق، وأن العقوبات في الشريعة الإسلامية تحقق أعظم المصالح بأقل التكاليف، وأن جميع الشبهات التي يرددها الطاعنون في الشريعة ووصفها بالقسوة والوحشية ناتجة عن جهل كبير بحقيقة التشريع الإسلامي الذي يوازن بين جميع الحقوق، بحيث، وأن في إقامة العقوبات في الإسلام من الحزم ما يكفي لزوال الجريمة وتقويم المجرمين ويحفظ الحقوق العامة، والخاصة، ويحقق الأمن المجتمعي في الأعراض، والدماء، والأموال، كما أوصى الباحث الدولة وخصوصا محاكم القضاء والشعب القضائية القيام بدورها الفعال بالعمل بالحزم تجاه كل المجرمين وإنزال العقوبة الشرعية كلا بحسب جرمه وعدم التساهل معهم لأن في تطبيق العقوبات الشرعية سعادة للفرد والمجتمع وحماية للأمن العام، وأوصى الباحث الجامعات ومراكز الأبحاث العلمية بالتوعية بضرورة العمل بالحزم في تطبيق العقوبات الشرعية وإنزال العقوبة المناسبة لكل مجرم واستكمال مواضع النقص في هذه القضية من قبل الباحثين وأوصى الباحث كل المرافق الحكومية وغير الحكومية بضرورة تطبيق القانون بحزم وجعل الناس سواسية أمام القانون حتى يسود حتى يسود العدل بين الناس ويحيا الناس بأمان ثم ختم الباحث هذا البحث بالمراجع أسأل الله له القبول والسداد والتوفيق.
This research entitled (The hardness and its impact on the legitimate punishments and its compatibility among individual rights and public rights) and consists of an introduction and three researches, in the first research the researcher talks on the terms and definitions, and in the second research, the researcher talks about the meaning of the penalties prescribed in the Shari'a. He pointed out that the Shari'a is based on two basic pillars: facilitation and hardness by tracing and extrapolation, the researcher found that by firmness the crime will be diminished and disappeared, and through establishing limits is establishing religion, and good for the world, happiness for individuals and communities. In the third research in which the researcher harmonize and balance the firmness between the right of the individual and the built society, On the famous rule that says (no harm nor harm ) The researcher concluded this research with some conclusions and recommendations, the most important of which are: the validity of Islamic legitimacy for every time and it’s place to harmonize among all rights, and the punishments in Islamic legitimacy achieved the greatest interests with the lowest costs. And all the suspicions echoed by the plaintiffs in the Sharia and described as cruelty and brutality result from a great ignorance of the Islamic legislation fact which balances all rights, and establishing punishment in Islam of the firmness is enough to eliminate the crime and repairing offenders and preserves public and private rights, and achieves community security in symptoms, blood, and money. The researcher also recommended the state especially the courts of justice and the judiciary to play an active role in acting resolutely against all criminals and imposing the legal punishment as a crime according to his crime and don’t tolerate them, because in the application of legitimate punishments is happiness for the individual , society and the protection of public security. Also The researcher recommended universities and scientific research centers to raise awareness to work firmly in the application of the legitimate punishments and impose the appropriate punishment for each criminal and complete the shortcomings in this case by the researchers and the researcher recommended all governmental and non¬governmental sections to apply the law firmly and make people equal in the law to prevail justice among People and live safely.
