يحاول الباحث في هذه الورقة إعطاء صورة جلية عن البيئة البحرية في الجمهورية اليمنية وضرورة تلازم مسألة الحفاظ عليها وطنياً ودولياً من خلال الاستفادة القصوى والاستئناس العلمي بالاتفاقيات والمعاهدات الدولية وقواعد ومبادئ القانون الدولي في هذا الاتجاه، وذلك من خلال توضيح مقومات البيئة البحرية: أهميتها وظاهرة تلوثها، وتبيان الجهود الوطنية لمنع تلويث البيئة البحرية، عبر إيضاح الجهود الانفرادية للجمهورية اليمنية. واستعراض التنظيم القانوني لمنع تلويث بيئتها البحرية، مع إبراز السياسة العامة التي تنتهجها الجمهورية اليمنية في مكافحة التلويث، والأساليب المستخدمة في تطبيقها، وآثارها التي تنعكس على مدى النطاق الذي تطبق فيه التشريعات اليمنية، مع تبيان الجهود الكبيرة والمتنوعة المبذولة والمتعلقة بالملوثات: مصدرها، والنشاط الذي يؤدي إلى التلويث، معطياً رؤية متكاملة عن موقف القانون الدولي والتشريعات الوطنية من تلوث البيئة، هادفاً في خاتمة الورقة إلى الخروج بجملة من الاستنتاجات والمقترحات والتوصيات التي يرى أنها ضرورية لتفعيل الجهود الوطنية لحماية البيئة البحرية ليس من حيث كونها مجالاً للنشاط الملاحي فحسب، ولكن لما تمثله من مصادر غذاء وهواء للإنسان، وأي إضرار بها يؤدي إلى أضرار ومخاطر جسيمة على صحة الإنسان والمجتمع ونموه وازدهاره وسلامة تطوره.
In this paper, the researcher tries to give a clear picture of the sea environment in the Republic of Yemen and stress on necessity to maintain it at national and international levels by benefiting from and scientifically seeking to consult international agreements, treaties, rules and principles of the international law in this regard by explaining the components of the marine environment, importance, and its pollution, and showing the national efforts to prevent sea environment pollution by explaining the unilateral efforts of the Republic of Yemen. He reviewed the legal organization to prevent pollution of its marine environmental pollution, together with explaining the anti- pollution general policy followed by the Republic of Yemen and methods used to apply it, and its effects as reflected on the extent to which Yemeni legislations are applied. He also shows the big and various efforts being made concerning pollutants and their sources and the activity which leads to pollution, giving integrated perspective on the attitude of the international law and national legislations from environment pollution. At the end of the paper he aimed at coming out with a group of conclusions, proposals and recommendations which he considers necessary for activating national efforts to protect sea environment not only as a domain of navigational activity but also as a source of food and air for man, and any harm done to it leads to considerable harm and risks to the health of man and society and its growth, prosperity as well as its development
