المستخلص: Divorce is a global social and demographic problem that is found in every society.
It is growing and increasing steadily in a way that raises many concerns and worries, as their consequences are not limited to one side but to the individual, the family, and society together.
Our paper's subject is not concerned only with the men of law and the judiciary but also extends to more than one discipline and field of knowledge, such as the scholars of social science, psychology, and religion.
The study of the phenomenon inevitably requires understanding the following headings:
• Causes of the phenomenon of divorce.
• The consequences of divorce.
• The Algerian legislator's involvement with the phenomenon.
• Solutions and suggestions.
The study also focuses on legal aspects in terms of treatment, effectiveness, and various difficulties in judicial practice.
We have concluded that while legal and judicial treatment is important, social, cultural, economic, civilizational, and ethical treatments remain first and foremost.

الطلاق مشكلة اجتماعية عالمية ديمغرافية لا يخلو منها مجتمع إنساني، وهي في تزايد وتنام مطرد بشكل يثير الكثير من الهواجس والقلائق، إذ أن تبعاتها لا تقتصر على جانب دون جانب بل تشمل الفرد والأسرة والمجتمع معا.
وموضوع مداخلتنا لا يشغل رجالات القانون والقضاء وحسب، بل يمتد إلى أكثر من تخصص ومجال معرفي كعلماء الاجتماع والنفس والدين.
ودراسة الظاهرة تقتضي حتما التعريج على العناوين الآتية:
• أسباب ظاهرة الطلاق.
• تبعات الطلاق.
• تعاطي المشرع الجزائري مع الظاهرة.
• الحلول والاقتراحات.
مع التركيز على الجوانب القانونية من حيث المعالجة والفعالية ومختلف الصعوبات التي تعرفها الممارسة القضائية.
وتوصلنا إلى أن المعالجة القانونية والقضائية وإن كانت على درجة من الأهمية، تظل المعالجات الاجتماعية والثقافية والاقتصادية والحضارية والأخلاقية على درجة أولى وأهم.


Le divorce est un problème social, mondial et démographique présent dans toutes les sociétés humaines, ce phénomène prend de l'ampleur de jour en jour ce qui engendre beaucoup de peur et d'appréhension vu que ces conséquences se répercutent sur les personnes, les familles et les sociétés aussi.
L'objet de notre intervention ne concerne pas que les représentants de la loi ou de la justice mais les dépasse à toutes les spécialités et les domaines du savoir tels que les sociologues, les psychologues et la religion.
L'analyse de ce phénomène demande impérativement d'aller vers les titres suivants: les causes du divorce. Les conséquences du divorce, l'approche des lois algériennes avec ce phénomène, les solutions attendues en se concentrant en premier lieu sur les côtés juridiques dans le traitement réel et efficace et dans les différentes difficultés que connait le domaine de la justice.
On a conclue que malgré l'importance du traitement juridiques mais les traitements et les approches sociaux, culturels, économiques et éducatifs restent primordiaux.
