المستخلص: The rapid development of communication systems has led to the widespread use of technological media in the field of economic activities in a way that has led to an acceleration of the pace of electronic commerce in various countries of the world, which made the international group organize it within the framework of the UNCITRAL Committee for Electronic Commerce. The Arab countries in general, and Algeria in particular, with their various legislations, are in direct confrontation with the rapid developments in the field of e-commerce, which suffers from many legislative, financial and human obstacles and has stood in the way of Arab countries catching up with the digital economy. L’évolution rapide des systèmes de communication a causé une vaste diffusion d’utilisation des moyens technologiques dans le domaine des activités économiques, en causant l’accélération du rythme du commerce électronique dans divers pays, ce qui a poussé la communauté internationale d’organiser ce dernier dans le cadre de la commission (UNCITRAL) concernant le commerce électronique. Sous l’effet de cette réalité, les états arabes en général, et l’Algérie à titre privé, avec leurs diverses législations, ont devenu opposables aux développements rapides dans le domaine commercial électronique, ce qui a mis ces états dans une situation gênante, sous la pression des obstacles législatifs, financiers et humains. Un ensemble qui a représenté une barrière qui a empêché ces états de répondre à l’évolution de la conjoncture mondiale en matière d’économie numérique.

أدى التطور السريع في أنظمة الاتصالات إلى الانتشار الواسع لاستخدام الوسائط التكنولوجية في مجال الأنشطة الاقتصادية بشكل أدى إلى تسارع وتيرة التجارة الإلكترونية في مختلف دول العالم، بما جعل المجموعة الدولية تنظمها في إطار لجنة اليونسترال للتجارة الإلكترونية، وأصبحت الدول العربية عامة والجزائر خاصة بمختلف تشريعاتها في مواجهة مباشرة مع التطورات السريعة في مجال التجارة الإلكترونية التي تعاني من العديد من العوائق التشريعية والمالية والبشرية وقفت حاجزا دون لحاق الدول العربية بركب الاقتصاد الرقمي.
