المستخلص: The Algerian legislature has paid attention to regulating the means of proving the endowment, given the latter's connection to a fundamental issue, which is the existence of the endowment and ensuring the achievement of its purposes and continuity. By referring to the legal texts related to evidence in the field of endowment property, the legislature left the area open to anyone interested in proving the endowment property by all legal and Islamic methods of proof. In order to give adequate legal protection to endowment funds, the legislature has introduced some methods of proof that are exclusive to the endowment. Le législateur algérien s’est intéressé d’organiser les moyens de preuve des biens wakfs, parceque ces moyens de preuve sont liés à une question substantielle concernant l’existence du wakf et la garantie de sa réalisation et sa continuité. Et lorsque on examine le dispositif législatif concernant les biens wakfs, il s’avère que le législateur a laissé le domaine libre à tout interésé de prouver le bien wakf par toutes les voies légales précisées par la chariâ islamique. Et pour donner une protection légale suffisante au biens wakf, le législateur s’est doté de plusieurs moyens de preuve concernant seulement le wakf.

اهتم المشرع الجزائري بتنظيم وسائل إثبات الوقف نظرا لارتباط هذه الأخيرة بمسألة جوهرية هي وجود الوقف وضمان تحقق مقاصده واستمراره. وبالرجوع إلى النصوص القانونية المتعلقة بالإثبات في مجال الأملاك الوقفية، فإن المشرع ترك المجال مفتوحا لكل ذي مصلحة لإثبات الملك الوقفي بجميع طرق الإثبات الشرعية والقانونية. ولإعطاء الحماية القانونية الكافية لأموال الوقف، فقد استحدث المشرع جملة من أساليب الإثبات التي يختص بها الوقف دون غيره.
