المستخلص: The area covered by the common lands was estimated at 03 million hectares, and this census was recorded after the Tunisian state gained complete independence in 1956. Common land is real estate owned by the group, which it disposes of under the supervision and guardianship of the state, through elected and administrative bodies established for the same purpose, in accordance with the conditions set by Law No. 82 of 1964 relating to the regulation of the basic system of common lands. It includes all the common lands belonging to the group, which it uses and disposes of collectively or by sharing its disposal on a family or individual basis. The Tunisian state exercises the right to supervise these works to protect the community from damaging its property and facilitate the revival of the common land. A l’aube de l’indépendance de la Tunisie (1956), les terres collectives couvraient environ 03 millions d’ha. la terre collective est un bien insaisissable, inaliénable et imprescriptible, Appartenant sous la tutelle administrative de l'Etat, au Groupement qui en jouit dans les conditions fixé par la loi n° 64-28 du 4 juin 1964 fixant le régime des terres collectives, Elle se compose de toutes les terres dont le groupement jouit collectivement ou dont les membres de la collectivité se sont partagés la jouissance à titre familial ou individuel. L'Etat tunisienne exerce un droit de tutelle sur ces actes, dans le but de préserver la collectivité de la dépossession et de favoriser la mise en valeur de la terre collective.

قدرت المساحة التي تغطيها الأراضي الاشتراكية حوالي 03 مليون هكتار، وقد سجل هذا الإحصاء بعد حصول الدولة التونسية على الاستقلال التام سنة 1956. والأرض الاشتراكية هي عبارة عن عقار مملوك للجماعة، التي تتصرف فيه تحت إشراف ووصاية الدولة، من خلال هيئات منتخبة وأخرى إدارية أنشئت للغرض ذاته، وفق الشروط التي حددها القانون رقم 82 لسنة 1964 المتعلق بضبط النظام الأساسي للأراضي الاشتراكية، وتشمل كافة الأراضي المشتركة التابعة للمجموعة، والتي تستغلها وتتصرف فيها بصورة جماعية أو باقتسام التصرف فيها بشكل عائلي أو فردي. وتباشر الدولة التونسية حق الإشراف على هذه الأعمال قصد حفظ الجماعة من إتلاف أملاكها وتسهيل إحياء الأرض الاشتراكية.
