| 520 | |f This study aims to analyze and discuss the reforms introduced by the Algerian legislature to the check system and the crime of issuing a check without balance, under Law No. 05-02 of February 06, 2005, amending and supplementing the Commercial Law, and Ordinance No. 15-02 of July 23, 2015, amending and supplementing Ordinance No. 66-155 of June 08, 1966, containing the Code of Criminal Procedure. This study ended with a statement of the importance of these reforms and their consequences in the field of commercial transactions by making them easier and more flexible in line with the principle of freedom of trade, mitigating the burden of criminalization in the field of criminal protection for the check, and restricting the Public Prosecution’s freedom to begin and initiate the public proceeding in the crime of issuing the check without balance, and the permissibility of mediation and conciliation in this regard through the public prosecutor and before him prior to any follow-up. | 520 | |d Cette étude vise à analyser et discuter les réformes introduites par le législateur algérien dans le système de chèque et le crime dʹémission de chèque sans solde, en vertu du code numéro 05- 02 en date du 06 février 2005 modifiant et complétant le code commercial, et lʹordonnance numéro 15- 02 en date du 23 juillet 2015 et complétant lʹordonnance numéro 66- 155 en date du 08 juin 1966 portant le code de procédure pénale. Lʹétude se termine avec une démonstration de l importance de ces réformes et les résultats obtenues dans le domaine de transactions commerciales, en les rendant plus faciles et plus souples en sʹadaptant au principe de la liberté commerciale, an allégeant la pression de la criminalisation dans le domaine de la prévention pénale du chèque, en limitant la liberté du parquet pour entreprendre une instance concernant le crime dʹémission de chèque sans solde, et la possibilité dʹen accepter la médiation et la réconciliation par lʹintermédiaire du procureur de la république et devant lui avant d entreprendre toute poursuite. | ||
| 520 | |a تهدف هذه الدراسة إلى تحليل ومناقشة الإصلاحات التي أدخلها المشرع الجزائري على نظام الشيك وجريمة إصدار الشيك دون رصيد، بموجب القانون رقم 05-02 المؤرخ في 06 فبراير 2005 المعدل والمتمم للقانون التجاري، والأمر رقم 15-02 المؤرخ في 23 يوليو 2015 المعدل والمتمم للأمر رقم 66-155 المؤرخ في 08 يونيو 1966 المتضمن قانون الإجراءات الجزائية. وانتهت هذه الدراسة ببيان أهمية هذه الإصلاحات والنتائج المترتبة عنها في مجال المعاملات التجارية، بجعلها أكثر سهولة ومرونة بما يتماشى مع مبدأ حرية التجارة، والتخفيف من وطأة التجريم في مجال الحماية الجزائية للشيك، وتقييد حرية النيابة العامة في تحريك الدعوى العمومية ومباشرتها في جريمة إصدار الشيك دون رصيد، وجواز قبول الوساطة والصلح بشأنها بواسطة وكيل الجمهورية وأمامه قبل أي متابعة. | ||
