| 520 | |f This study aims to clarify the position of the Algerian legislature on the crime of trafficking in persons and how it deals with this dangerous type of crime. Since trafficking in persons is one of the main activities within the scope of organized crime, we have tried, through this study, to refer to the definition of organized crime and its relationship to trafficking in persons. We also tried to highlight the significant forms of trafficking in persons and their severity. The study concluded that if the Algerian legislature does not set a special law for this dangerous type of crime, it will not be able to limit it. And that it is sufficient to refer to trafficking in persons in the Penal Code and to paint the characterization of the association of villains, Article (176) of the Algerian Penal Code on organized crime is not sufficient to achieve the fight. | 520 | |d La présente étude a pour objet de préciser la position du législateur Algérien au sujet du trafic humain, et sa façon de traiter ce type dangereux de criminalité. Etant donné que le trafic humain est considéré comme étant une activité entrant dans le domaine du crime organisé, nous avons essayé, d'expliquer et de faire connaître le crime organisé et sa relation avec le trafic humain. Nous avons aussi essayé de mettre en évidence les types les plus importants du trafic humain, et à quel point ils sont dangereux. L'étude a abouti au fait que si législateur Algérien ne met pas en place le plus rapidement possible un code spécial afin de contenir ce phénomène, il ne pourra jamais elle contrecarrer. Se suffire à mentionner le trafic humain dans le code pénal, et parler de qualification juridique quand il s'agit de constitution d'association de malfaiteurs alors qu'il s'agit de trafic humain (article 176 du code pénal Algérien) ne suffira jamais à réaliser la lutte contre le trafic humain. | ||
| 520 | |a تهدف هذه الدراسة إلى بيان موقف المشرع الجزائري من جريمة الإتجار بالأشخاص وكيفية معالجته لهذا النمط الخطير من الإجرام. وبما أن الاتجار بالأشخاص يعد من أهم الأنشطة الداخلة في نطاق الجريمة المنظمة، فقد حاولنا من خلال هذه الدراسة الإشارة إلى تعريف الجريمة المنظمة وعلاقتها بالإتجار بالأشخاص. كما حاولنا إبرازا لأهم أشكال جريمة الاتجار بالأشخاص ومدى خطورتها. وقد توصلت الدراسة إلى أن المشرع الجزائري إن لم يضع لهذا النوع الخطير من الجرائم قانوناً خاصاً فلن يستطيع الحد منه. وأن الاكتفاء بالإشارة إلى الإتجار بالأشخاص في قانون العقوبات، وإصباغ التكييف القانوني الخاص بجمعية الأشرار المادة (176) قانون العقوبات الجزائري على الجريمة المنظمة لا يكفي لتحقيق المكافحة. | ||
