المستخلص: The owner of the building has the right to demolish the building as he wants, in whole or in part, but due to the construction site, the legislature intervenes to impose special conditions for the demolition process within the framework of administrative control and maintaining public order, especially if the building to be demolished, is located in a classified place or on the way of the classification in the list of national properties with cultural advantage. This restriction and conditions are not intended to limit the freedom of the building owner to dispose of his property, but rather in order to preserve the national cultural property from the possible damage to it during the demolition process, and this is by stipulating an essential mechanism stipulated in the Algerian Urban Law, which is the demolition permit. Le propriétaire du bâtiment a le droit de démolir sa construction comme il veut, en tout ou en partie, mais en raison de la position de construction intervient le projet pour imposer un processus privé de conditions de démolition, dans les domaines administratifs et dans le cadre du maintien de l'ordre public, surtout si le bâtiment à être démoli se trouve dans le lieu du travail ou dans la voie de classement dans la liste des biens nationaux à caractère culturel, cette restriction et ces conditions ne sont pas destinés à limiter la liberté du propriétaire du bâtiment, mais elle vise à préserver la propriété nationale culturelle contre les dégâts qu'elle en résulte pendant le processus de démolition, on doit imposer des mécanismes comme il indique le code de l'urbanisme algérien: c'est "le permis de démolition".

من حق مالك البناء هدم بناءه كيفما يشاء كلياً أو جزئياً، ولكن نظرا لموقع البناء يتدخل المشرع ليفرض شروطا خاصة بعملية الهدم، في إطار الضبط الإداري والمحافظة على النظام العام، لاسيما إذا كان البناء المراد هدمه واقعا في مكان مصنف أو في طريق التصنيف في قائمة الأملاك الوطنية ذات الميزة الثقافية، وهذا التقييد والشروط ليس الغرض منهما الحد من حرية مالك البناء في التصرف بملكه، وإنما لأجل المحافظة على الأملاك الوطنية الثقافية جراء الأضرار التي قد تلحق بها خلال عملية الهدم، وهذا باشتراط آلية جد مهمة من الآليات التي نص عليها قانون العمران الجزائري ألا وهي رخصة الهدم.
