المستخلص: This study was conducted to examine the commitment to electronic information prior to contracting, as it is the most important commitment imposed at this stage, aiming to enlighten the consumer's will about the contract conditions. The problem raised was about how the legislature regulates this obligation, and to answer that, the analytical method was adopted, and the study was divided into two sections. The first section was devoted to defining the nature of this obligation, while the second section included a study of the various provisions stipulated for it. The study concluded that the Algerian legislator dedicates this obligation to a basic electronic contract guarantee. This abstract was translated by Dar AlMandumah Inc

Cette étude est une rechèrche sur l’obligation d’information électronique qui précède la conclusion du contrat ;étant donnée qu’elle est la principale obligation apposée à l’auteur de l’offre à cette phase,puisqu’elle vise à éclairer la volonté de la partie cocontractante éventuelle - à savoir le consommateur- sur les circonstances éventuelles de conclusion du contrat. La problematique soulevée est: Comment le législateur national a-t-il règlementé cette obligation? Pour répondre à cette problematique nous avons adopté la méthode analytique qui nous a mené vers deux chapitres ;le premier est consacré à la définition de cette obligation,alors que le second traite des différents règlements y applicables. En conclusion, l’étude aboutie à la concrétisation de cette obligation par le législateur national comme étant une garantie fondamentale dans les contrats électroniques.

جاءت هذه الدراسة للبحث في الالتزام بالإعلام الإلكتروني السابق للتعاقد، باعتباره أهم التزام مفروض في هذه المرحلة، يهدف إلى تنوير إرادة المستهلك حول ظروف التعاقد. فكانت الإشكالية المثارة حول كيفية تنظيم المشرع لهذا الالتزام، وللإجابة على ذلك أعتمد المنهج التحليلي، فقسمت الدراسة إلى مبحثين، خصص المبحث الأول للتعريف بماهية هذا الالتزام في حين تضمن المبحث الثاني دراسة مختلف الأحكام المقررة له. فخلصت الدراسة إلى نتيجة تتمثل في تكريس المشرع الجزائري لهذا الالتزام باعتباره ضمانة أساسية في العقود الإلكترونية.
