المستخلص: It is evident that the personal responsibility of the doctor is based on three pillars where this responsibility cannot be raised without them; however the medical work’s new concept is done by a collective team that consists of surgeon, an anesthetic and a recovery doctors to medical assistants and others. Moreover, to determine the responsibility of each individual on the medical errors that may result from the surgical intervention is very complex, and the affirmation of the independence of the anesthesiologist technically, has led to a change in the data of the problem of responsibility and how to determine it. So if we take the principle of the distribution of responsibilities between the anesthesiologist and the surgeon narrowly, this leads to condemn the anesthesia specialist alone, this is what led to the introduction of the idea of the surgical team. So The surgeon play the role of a guide to the surgical work in his group, which is necessary to him to assure himself that all the precaution and safety measures are respected. Then we can say that there is a common area of competences, and that the responsibility of the surgeon and anesthesia doctors can arise errors that result from their joint competences. From here we can say that; there is no possibility to totally separate between the members of the surgical team regarding their responsibility on their mistakes.

من البديهي أن المسؤولية الشخصية. للطبيب تقوم على ثلاث أركان، حيث لا تنعقد هذه المسؤولية دون تجمعها غير أن العمل الطبي أصبح يتم وسط فريق جماعي يتكون من الجراح، وطبيب التخدير والإنعاش إلى مساعدين طبيين وغير ذلك وأن تحديد مسؤولية كل فرد عن الأخطاء الطبية التي قد تنجم عن التدخل الجراحي جد معقدة وأن تأكيد استقلال طبيب التخدير من الناحية الفنية أدى إلى تغيير في معطيات مشكلة المسؤولية، فإذا أخذنا بمبدأ توزيع المسؤوليات على نحو ضيق بين طبيب التخدير والطبيب الجراح فإن ذلك يؤدي إلى إدانة أخصائي التخدير بمفرده، وهذا ما أدى إلى استحداث فكرة الفريق الجراحي، فالجراح يقوم بدور المرشد للعمل الجراحي في مجموعته وهذا ما يلزمه بأن يتأكد بنفسه من أن كل تدابير الاحتياط والسلامة قد رعيت، وعليه يمكن القول أن هناك منطقة اختصاصات مشتركة وأن مسؤولية الجراح وطبيب التخدير يمكن أن تثور من أجل خطأ يتعلق بهذا الاختصاص المشترك بينهما، ومن هنا يمكن القول بعدم إمكانية الفصل التام بين أعضاء الفريق الجراحي فيما يخص تحمل مسؤولية الأخطاء الناجمة عن التدخل الجراحي.
