المستخلص: Les statuts personnels pourraient bénéficier du développement des moyens modernes de communication, de façon qu’il est possible de nos jours de mettre, par le biais desdits moyens, un terme au mariage, en l’occurrence la dissolution du mariage alors que cette voie était jadis inexistante. Cette voie de divorce a fait l’objet d’une polémique doctrinale, d’aucuns la voient comme un mépris de la sacralité de la relation conjugale, alors que d’autres la considèrent en parfait accord avec les techniques modernes de communication en matière de divorce. Face à cette controverse doctrinale, le législateur familial est passé sous silence sur cette question, car le code algérien de la famille demeure muet sur le divorce par voie électronique.

كان للأحوال الشخصية نصيب من تطور وسائل الاتصال الحديثة، فاستجدت نوازل في باب الطلاق، لم تكن موجودة ولا معهودة سابقا، حيث أصبح بالإمكان حل الميثاق الغليظ إلكترونيا. وأمام هذه النازلة، انقسمت آراء الفقهاء، فالبعض يرى فيه استخفاف بقدسية العلاقة الزوجية، فيما يعده آخرون تماشيا مع التقنيات الحديثة. أما المشرع الأسري سكت عنه، بحيث لا توجد في قانون الأسرة الجزائري مادة صريحة ومباشرة تنظم الطلاق الإلكتروني.

The personal statuses could benefit from the development of the modern means of communication, so that it is possible nowadays to put, by means of these means, a term to the marriage, in this case the dissolution of the marriage whereas this way was formerly nonexistent. This path of divorce has been the subject of a doctrinal controversy; some see it as a contempt for the sacredness of the marital relationship, while others consider it in perfect agreement with the modern techniques of communication in matters of divorced. Faced with this doctrinal controversy, the family legislator is silent on this issue, because the Algerian code of the family remains silent on the divorce by electronic means.
