المستخلص: L'évolution économique et sociale affectant le financement et la gestion publique, a conduit le législateur algérien à embrasser les contrats de délégation de service public comme mode nouveau de gestion par le biais du décret présidentiel n° 15 - 247, et ce, afin d'assurer une plus grande efficacité dans la gestion, en améliorant la qualité des services publics d'une part, et la rationalisation des dépenses publiques, qui permettrait une diversification des modes de financement des entreprises publiques, d'autre part. C'est ce que nous tenterons de mettre en exergue dans cette étude, tout d'abord le rôle des contrats de délégation en tant que nouvelle méthode de gestion et de passation de marchés publics, ainsi que son efficacité.

نتيجة للتحولات الاقتصادية والاجتماعية وما لها من تأثير على التمويل والتسيير العمومي، فقد اتجهت إرادة المشرع الجزائري نحو تكريس عقود تفويض المرفق العام كأسلوب جديد للتسيير في ظل المرسوم الرئاسي رقم 15- 247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، بما يضمن فعالية أكبر في التسيير، من خلال تحسين نوعية الخدمات العمومية من جهة، وترشيد النفقات العمومية بما يسمح بتنويع أنماط تمويل المشاريع العمومية من جهة أخرى. هذا ما سنحاول تبيانه في هذه الدراسة التي ارتأينا من خلالها تسليط الضوء على دور عقود تفويض المرفق العام كأسلوب جديد للتسيير والتعاقد الإداري ومدى نجاعته في ظل المرسوم الرئاسي رقم 15- 247 المتضمن تنظيم الصفقات العمومية وتفويض المرفق العام.

Due to the economic and social evolution that affects the financing and the public management, led the will of the Algerian legislator to dedicate the contracts of the public service delegations like means of a new conduct under the presidential decree n° 15 - 247, ensuring greater efficiency in management, by improving the quality of public services on the one hand, and the rationalization of public expenditures, which would allow a diversification of the modes of financing of public enterprises on the other hand. This is what we will try to explain in this study, through which we have highlighted the role of General Facility delegation contracts as a new management and procurement method, as well as its effectiveness. under Presidential Decree No. 15 - 247 regulating public procurement and public service delegation.
