المستخلص: L’adoption par le législateur de la tutelle se justifie, en principe, par le fait de préserver les biens des mineurs et de protéger leurs intérêts financiers de la cupidité d’autrui. Mais, en présence actuellement de l’avilissement religieux, et de la malhonnêteté chez une franche de la société, la concupiscence de certains tuteurs, eux-mêmes, sur les biens du mineur n’est point à disjoindre surtout dans une société où le matérialisme bas son plein et ce, particulièrement face à une concision réglementaire inappropriée quant aux sanctions que devraient subir le tuteur en cas de carence à ses obligations.

وجدت الولاية حفاظا على أموال القصر وحماية لمصالحهم المالية من طمع الغير فيها. لكن، وفي ظلّ انخفاض الوازع الديني والأخلاقي الذي نعايشه في مجتمعنا، وضعف نفوس كثير من الأولياء، أصبحت أموال القاصر محل طمع من الولي نفسه، خاصة أمام نقص التشريع فيما يتعلق بالجزاءات التي توقع على الولي في حال الإخلال بالتزاماته.

The adoption by the legislature of the guardianship is justified, in principle, by preserving the property of minors and protecting their financial interests from the greed of others. But, in the present presence of religious degradation, and of dishonesty in a frank of society, the concupiscence of certain guardians, they themselves, on the possessions of the miner, are not to be disjointed above all in a society where materialism is in full swing, particularly in the face of improper regulatory conciseness as to what sanctions should be imposed on the guardian in the event of deficiency.
