المستخلص: En droit algérien, il est de principe d’ordre public qu’après le divorce prononcé judiciairement, les conjoints devenant étrangers l’un à l’autre, peuvent librement, après conclusion d’un second mariage, reprendre de nouveau la vie conjugale. Toutefois, cette liberté se trouve parfois limitée pour faire obstacle à la multiplicité des divorces-répudiations. C’est dire que notre droit familial dresse une barrière légale à l’époux répudiant successivement sa femme. Ainsi en est-il du triple divorce où le remariage de la divorcée avec son ex-époux devient interdit. Il s’agit là d’une interdiction temporaire, voire d’un empêchement à mariage momentané du fait que cette interdiction peut être levée par la conclusion d’un mariage intermédiaire libérateur, mais pourvu que ses clauses soient réunies, à défaut il sera considéré comme nul.

In Algerian law, it is a principle of public order that after the divorce pronounced judicially, the spouses becoming foreign to each other, can freely, after conclusion of a second marriage, resume married life. However, this freedom is sometimes limited to prevent the multiplicity of divorces-repudiations. This means that our family law sets up a legal barrier to the husband successively repudiating his wife. This is the case with the triple divorce where remarriage of the divorced woman with her ex-husband becomes prohibited. This is a temporary prohibition, or even an impediment to temporary marriage because this prohibition can be lifted by the conclusion of a liberating intermediate marriage, but provided that its clauses are met, failing this it will be considered null.
