المستخلص: Through this study, we tried to recount the struggle of the Algerian journalism before independence until the eve of the first official law on media in independent Algeria. The profession of a journalist has always been in clash with the political changes that have taken place in the country on the one hand and the will of the press professionals to lift the challenge and ensure the continuity of the profession of trouble on the other. Not to mention the threats that have been hovering over the press, from the threat of terrorism to what some legislation relating to the media contained (Penal Code Amendment 2001). Accordingly, we conducted a chronological study of the development of media legislation in Algeria with an analysis of the most important political centres known to the country, where they played a significant role in the promulgation of the official law in 2012, until the Algerian press was degraded in 2016.

من خلال هذه الدراسة، حاولنا سرد كفاح الصحافة الجزائرية قبيل الاستقلال إلى غاية عشية صدور أول قانون عضوي متعلق بالإعلام في الجزائر المستقلة. لقد كانت مهنة الصحفي دوما متصادمة مع التغيرات السياسية التي شهدتها البلاد من جهة وإرادة مهنيو الصحافة في رفع التحدي وضمان استمرارية مهنة المتاعب من جهة أخرى؛ ناهيك مع التهديدات التي كانت تحوم بالصحافة، من خطر الإرهاب تارة إلى ما تضمنته بعض التشريعات المتعلقة بالإعلام تارة أخرى (قانون العقوبات المعدل 2001). وعليه، قمنا بدراسة كرونولوجية لتطور التشريعات الإعلامية في الجزائر مع تحليل أهم المحطات السياسية التي عرفتها البلاد، حيث كان لها الدور الكبير في صدور القانون العضوي 2012، إلى غاية دسترة مكتسبات الصحافة الجزائرية في 2016.

A travers cette étude, nous avons essayé de retracer le combat de la presse algérienne depuis la veille de l'indépendance jusqu'à l'aube du premier code organique de l'information de l'Algérie indépendante.
En effet, le métier de journaliste a toujours été confronté tantôt à l'évolution politique qu'a connu notre pays ainsi qu'à la volonté des praticiens de ce métier à relever le défi et assurer la continuité de cette noble profession face aux menaces aussi bien terroristes (après les événements du 05 octobre 1988) qu'à celles inscrites dans les législations dédiées à l'information en Algérie (Code pénal 2001).
Aussi, nous avons repris toutes ces étapes et les avons analysées dans leurs contextes respectifs en se basant sur une méthode chronologique. Il n’en demeure pas moins que grâce au combat des journalistes algériens et à la bonne volonté politique de faire de la presse algérienne un modèle dans les pays émergeants, le code organique de l'information a vu le jour en 2012 et que de nombreux acquis ont été constitutionnalisés en 2016.
