المستخلص: لن يستطيع الأزهر الشريف أن يقوم بمهامه على أكمل وجه إلا إذا كان يتمتع بالاستقلال سواء من الناحية المالية أو الإدارية؛ وذلك بأن يكون غير تابع لأي سلطة من سلطات الدولة تتحكم فيه وني قراره وتوجهه حيثما شاءت؛ ومن ثم تبدو أهمية تكريس استقلال الأزهر الشريف كأساس لأداء رسالته السامية. ولكي يتمتع الأزهر الشريف بالاستقلال؛ فينبغي أن تتوافر دعائم وأسس استقلاله والتي تمثل المعايير التي نستطيع القول عند توافرها بأن الأزهر الشريف يتمتع بالاستقلال. وإذا كان التكريس الدستوري والقانوني لاستقلال الأزهر الشريف يضمن عدم العبث بالأزهر الشريف، كما يضمن له أدائه لرسالته دون تأثير من أي جهة أخرى محلياً وإقليمياً وعالمياً، إلا أن هذا الاستقلال لا يعني أن يكون الأزهر الشريف دولة داخل الدولة - كما يدعي البعض-؛ ومن ثم فلا مجال للقول بأن رسالته تتصادم أو تتعارض مع الرسالة التي تؤديها سلطات ومؤسسات الدولة، بل إن للأزهر دور تكاملي بين رسالته والرسالة التي تؤديها السطات والمؤسسات الأخرى في الدولة. وبناء على ما تقدم تتناول هذه الدراسة موضع استقلال الأزهر الشريف، من حيث بيان الأسس التي يقوم عليها هذا الاستقلال، ثم بيان مدى توافر أسس هذا الاستقلال في الفترات المختلفة التي مر بها الأزهر الشريف منذ إنشائه وحتى الآن، سواء فترة ما قبل التنظيم القانوني للأزهر الشريف، ثم فترة التنظيم القانوني له، وأخيراً فترة النص الدستوري على استقلال الأزهر الشريف، وفي نهاية هذه الدراسة نبين مدى العلاقة بين رسالة الأزهر الشريف ورسالة سلطات ومؤسسات الدولة في ضوء منحه الاستقلال الدستوري والقانوني، وما إذا كان هذا الاستقلال يعد عقبة تحول دون التكامل بينه وبين تلك المؤسسات، أم أنه داعم له.

Al-Azhar Al-Sharif will not be able to fully carry out its tasks unless it enjoys independence, whether financially or administratively by not being subordinate to any of the governmental authorities that control it, its decision and direct it wherever it wants. Hence, the importance of consecrating the independence of Al-Azhar as a basis for carrying out its noble mission appears. For Al-Azhar Al-Sharif to enjoy independence; so the foundations of its independence should be present, which represent the criteria upon which we can say that the noble Al-Azhar enjoys independence? And if the constitutional and legal consecration of the independence of Al-Azhar guarantees that the noble Al-Azhar will not be tampered with, and that it guarantees its performance of its mission without influence from any other party locally, regionally and globally, but this independence does not mean that Al-Azhar is a state within the state - as some claim -; Hence, there is no room for saying that his message clashes or conflicts with the message that the state authorities and institutions perform. Rather, Al-Azhar has an integral role between his message and the message that other authorities and institutions in the state perform. Accordingly, this study deals with the issue of the independence of Al-Azhar, in terms of explaining the foundations on which this independence is based, and then explaining the availability of the foundations for this independence in the different periods that Al-Azhar has gone through since its establishment until now, whether before the legal organization of Al-Azhar then, the period of legal organization for it, and finally the period of the constitutional text on the independence of Al-Azhar. At the end of this study, we display the extent of the relationship between the mision of Al-Azhar and the mision of state authorities and institutions in light of granting it constitutional and legal independence, and whether this independence is an obstacle to the integration between it and those institutions, or it supports it.
