المستخلص: The Algerian legislature has adopted a number of legal means and mechanisms granted to the authorities in order to protect and preserve the environment. One of these mechanisms is the financial penalty, which is considered one of the most important mechanisms as it relates to the financial aspect. It contributes to reparation for the damage caused by the polluter based on the polluter's motivation principle. The nature of this mechanism is that its funds are directed to the preservation of the environment, and the legislator intervened in it by two aspects; a deterrent aspect and a motivational aspect, all of which contribute effectively to the protection of the environment. However, this mechanism does not function until the financial penalty commensurates with the damage caused.

لقد اعتمد المشرع الجزائري جملة من الوسائل وآليات القانونية منحها للسلطات من أجل حماية البيئة والمحافظة عليها ومن هذه الآليات العقوبة المالية التي تعتبر إحدى أهم الآليات كونها تتعلق بالجانب المالي، فهي تساهم في جبر الضرر الذي تسبب فيه الملوث انطلاقًا من مبدأ الملوث الدافع كما أن طبيعة هذه الآلية أن أموالها موجهة إلى المحافظة على البيئة كما أن المشرع تدخل فيها بجانبين جانب ردعي وآخر تحفيزي كل ذلك يساهم بصورة فعالة في حماية البيئة ولكن تبقى هذه الآلية لا تؤدي دورها حتى تتناسب العقوبة المالية مع الضرر المتسبب فيه.

Législateur algérien a adopté un certain nombre de moyens et de mécanismes juridiques accordés aux autorités pour protéger l'environnement et la conservation, et ces mécanismes de sanction financière, qui est l'un des mécanismes les plus importants en ce qui concerne l'aspect financier, ils contribuent aux réparations causées par l'instance contaminée du principe de la motivation du pollueur quant à la nature de la ce mécanisme que les fonds dirigés vers la préservation de l'environnement et de l'intervention du législateur dans lequel deux aspects en même temps que de dissuasion et de motivation dernière tout cela contribue efficacement à la protection de l'environnement, mais le mécanisme reste ne jouent pas leur rôle afin que la peine financière en rapport avec le préjudice causé.
