المستخلص: تتسابق الدول العظمى اقتصادياً وعلمياً لاختراع دواء جديد لفيروس كورونا "كوفيد -19" الخطير؛ وعندما يتم إنتاجه، فمن المتوقع أن تنجم بعض المعضلات والصعوبات التي ترتبط بمسألة الحصول عليه؛ وذلك عندما تتمسك الشركة أو الدولة المنتجة بحقوق الملكية الفكرية، وخاصة حقوق البراءة لهذا الدواء، التي تعطيها حق الاستثمار والاحتكار بصناعته وتسويقه وبيعه. فالحق في سرية المعلومات، وحق والاستئثار بحقوق البراءة، هما سلاح الشركات الدوائية التي تسعى جاهدة إلى التوصل لاختراع دواء جديد لعلاج المصابين بهذا الفيروس؛ لأنهما بمثابة الأداة لاحتكاره والتحكم في سوق الدواء والعلاج، لكنهما من جهة أخرى ونظراً لخصوصية الوضع الصحي الراهن في ظل هذا الوباء سيكونان سبباً لمنع أبسط الحقوق المشروعة وهو الحق في الصحة. لذا نحاول من خلال هذه الدراسة الوقوف على مدى إمكانية الموازنة بين الحقين المتعارضين، وما هي الحلول والفروض المتاحة في ضوء القوانين الوطنية والاتفاقات الدولية المتعلقة بحقوق الملكية الفكرية ومدى مواءمتها لمواجهة تحديات الأزمة الراهنة. وفي النهاية فالوضع الحالي لانتشار وباء كورونا والتي اهتزت على إثره عروض أقوى الدول الاقتصادية ينذر بمشكلة دولية عظمى بشأن التمكن من الحصول على الدواء المنتظر. وبالتالي فهناك ضرورة لعقد جولة أخرى من المفاوضات بين الدول الأعضاء في اتفاقية التريبس بشأن التشجيع الفعلي لنقل التكنولوجيا في مجال صناعة دواء كورونا والحفاظ على الصحة العامة. كما أنه لابد من العمل على إيجاد آليات من شأنها العمل على حماية حقوق الملكية الفكرية دون تهديد أو مساس بالحق في الصحة، وتيسير سبل الدول النامية والأكثر فقراً في الركون لسياسات الاستيراد الموازي والتراخيص الإجبارية كل بحسب ظروفه في ظل الأزمة الراهنة، لتوفير احتياجاتهم من دواء كورونا بأسعار ميسرة تكون بمتناول جميع المرضى.

The great powers are racing economically and scientifically to invent a new drug for the dangerous "Covid-19" virus; When it is produced, it is expected that some dilemmas and difficulties related to the issue of obtaining it will arise; This is when the company or the producing country adheres to the intellectual property rights, especially the patent rights for this drug, which gives it the right to monopolize and monopolize the rights to manufacture, market and sell it. The right to confidentiality of information and the exclusive right to patent rights are the weapons of pharmaceutical companies that strive to come up with the invention of a new drug to treat those infected with this virus; Because they are a tool for his monopoly and control in the drug and treatment market, but on the other hand, and due to the specificity of the current health situation in light of this epidemic, they will be a reason to prevent the most basic legitimate rights, which is the right to health. Therefore, we are trying, through this study, to determine the extent to which a balance is possible between the two conflicting rights, and what solutions and assumptions are available in light of national laws and international agreements related to intellectual property rights, and the extent of their compatibility to face the challenges of the current crisis. In the end, the current situation of the spread of the Corona epidemic, which has shaken the thrones of the most powerful economic countries, foreshadows a major international problem regarding being able to obtain the expected medicine. Consequently, there is a need to hold another round of negotiations between the member states of the TRIPS Agreement regarding the actual encouragement of technology transfer in the field of Corona medicine industry and the preservation of public health. It is also imperative to work to find mechanisms that will work to protect intellectual property rights without threatening or prejudice to the right to health, and to facilitate ways for developing and poorer countries to rely on parallel import policies and compulsory licenses, each according to their circumstances in light of the current crisis, to provide their needs from Corona medicine.
