المستخلص: Public deals go through stages before their conclusion and implementation and are subject to various control processes such as pre-external oversight, which the Public Procurement Committees practice. It is created at each contracting authority level and entrusted with conforming the public procurement to the legislation and regulation in force.
Through our study of the State Public Procurement Committee, its importance in oversight has been demonstrated, given the distinguished legal system that the legislator has assigned to it, and its enjoyment of a composition that includes active members in the field of local development, who have a permanent and continuous relationship with public procurement, in addition to representatives of the Ministry of Finance at the local level, as well as local elected members. As for its competence, it is to control the conformity of each condition of the contract of transactions, deals, and transaction supplements to the legislation and regulation in force provided by the contracting authority, so that this oversight culminates in a visa granted by the competent procurements committee to enable the contracting authority to conclude the deals with contractor, or refusal to grant a visa if there is a violation of applicable legislation and regulation.
So the purpose of exercising external oversight over public deals by the state committee is to preserve public money and achieve local development.

تمر الصفقات العمومية بمراحل قبل إبرامها وتنفيذها، وتخضع لعمليات الرقابة المختلفة على غرار الرقابة الخارجية القبلية، التي تمارس من طرف لجان الصفقات العمومية. التي يتم إحداثها على مستوى كل مصلحة متعاقدة، والمنوط بها مطابقة الصفقات العمومية للتشريع والتنظيم المعمول بهما.
ومن خلال دراستنا للجنة الصفقات العمومية الولائية، تبين مدى أهميتها في مجال الرقابة، وذلك بالنظر إلى النظام القانوني المتميز الذي خصها به المشرع، وتمتعها بتشكيلة تضم الأعضاء الفاعلين في مجال التنمية المحلية، والذين لهم علاقة دائمة ومستمرة بالصفقات العمومية، بالإضافة إلى ممثلي وزارة المالية على المستوى المحلي، وكذا المنتخبين المحليين. أما عن اختصاصها، فيتمثل في رقابة مدى مطابقة كل من دفاتر الشروط الخاص بالصفقات، الصفقات، وملاحق الصفقات للتشريع والتنظيم المعمول بهما والمقدمة من طرف المصلحة المتعاقدة، لتتوج هذه الرقابة بتأشيرة تمنحها لجنة الصفقات المختصة، لتمكِّن المصلحة المتعاقدة من إبرام الصفقة مع المتعاقد معها، أو رفض منح التأشيرة إذا كانت هناك مخالفة للتشريع والتنظيم المعمول بهما.
إذا فالغاية من ممارسة الرقابة الخارجية على الصفقات العمومية من طرف اللجنة الولائية، هو المحافظة على المال العام، وتحقيق التنمية المحلية.


Le contrôle des marchés publics est caractérisé par son étendue et sa diversité. Il se manifeste à tous les niveaux et à travers des phases différentes à savoir : avant la passation de marché, pendant ou après l’exécution de celui-ci.
Le plus important de ces contrôles est le contrôle externe a priori. Ce dernier, vise principalement à vérifier la conformité des marchés publics par rapport à la législation et à la réglementation en vigueur.
Dans notre étude, il y a lieu d’indiquer que la commission des marches publics de wilaya, régies par un régime juridique très particulier s’intéressant à ces compositions, Soutenu par des membres actifs dans le développement local, En plus des représentants du ministère des Finances au niveau local, ainsi que les élus locaux.
L’exercice du contrôle externe à priori par la commission de marchés approprié nécessite de la part du service contractant, la présentation d’un dossier complet. L’examen de ce dossier donne lieu soit à la délivrance d’un visa autorisant l’exécution du marché soit par un refus qui doit être motivé.
Donc le but de contrôle externe a priori exercé par la commission de wilaya, c’est d’assurer une meilleure protection des biens et des deniers publics.
