المستخلص: Due to the rapid development of transactions and changing economic conditions, most of the legislation, including the Algerian legislature, tried to keep pace with this development, which was achieved at the expense of the well-known rules in the traditional penal law. Therefore, we find that the Algerian legislature, while regulating the economic aspect, stipulated special provisions and principles that fall outside the general rules in the penal code, among which is the privacy at the level of the legal pillars required by economic crime, where we find the clear change in the features of the legal element, as well as the ambiguity of the material element of economic crime in addition to the weakness of the moral element in some economic crimes.

نظرا لسرعة تطور المعاملات وتغير الظروف الاقتصادية حاولت أغلب التشريعات ومن بينها المشرع الجزائري إلى مواكبة هذا التطور، الأمر الذي تحقق على حساب القواعد المعروفة في القانون الجزائي التقليدي، لذلك نجد أن المشرع الجزائري وأثناء تنظيمه للجانب الاقتصادي نص على أحكام ومبادئ خاصة تخرج عن القواعد العامة في قانون العقوبات، والتي من بينها الخصوصية على مستوى الأركان القانونية التي تتطلبها الجريمة الاقتصادية، حيث نجد التغير الواضح في ملامح الركن الشرعي، وكذلك غموض الركن المادي للجريمة الاقتصادية، بالإضافة إلى ضعف الركن المعنوي في بعض الجرائم الاقتصادية

En raison du développement rapide des transactions et des conditions économiques changeantes, la plupart des législations, y compris le législateur algérien, ont essayé de suivre ce développement, ce qui a été réalisé au détriment des règles connues dans le droit pénal traditionnel. Par conséquent, le législateur algérien, tout en organisant le côté économique, En ce qui concerne les règles générales du Code pénal, y compris la vie privée au niveau des éléments juridiques requis par le crime économique, où nous trouvons un changement clair dans les caractéristiques du coin légal, ainsi que l'ambiguïté de l'élément physique de la criminalité économique en plus de la faiblesse de l'élément moral de certains crimes Économique, amis en valeur des reglesspecieles hors la conception traditionnelle du code pènal.
