| 520 | |f The arbitration system is one of the alternative means and mechanisms for resolving disputes that may arise regarding patents of manufacturing. It is regarded among the activities related to the industrial field and that is with the difference of the fields in which they may exist. Perhaps these problems which are associated with the patent system have put us before a conflicting set of law that is relevant to the subject, is applicable or rather presupposes an attempt by the arbitral tribunal to reach a solution acceptable to the disputing parties. As such, a prior agreement between those parties is presumed to be an arbitration clause, or may be in the form of a subsequent agreement and it means a condition of arbitration.\nThis abstract translated by Dar AlMandumah Inc. 2021 | ||
| 520 | |a يعتبر النظام التحكيمي أحد الوسائل والآليات البديلة لحل المنازعات التي قد تثور بشأن براءات الاختراع، خاصة وأنها تدرج ضمن موضوعات النشاطات المتعلقة بالمجال الصناعي وذلك باختلاف الميادين التي قد توجد بها، ولعل أن هذه الإشكالات المرتبطة بنظام البراءات تضعنا بالضرورة أمام تزاحم مجموعة القوانين التي لها علاقة بالموضوع تكون واجبة التطبيق أو بالأحرى يفترض إعمالها محاولة من الهيئة التحكيمية للوصول إلى حل للنزاع يناسب الأطراف المتنازعة، وعلى هذا الأساس يفترض وجود اتفاق مسبق بين هؤلاء الأطراف يتمثل في شرط التحكيم، أو يمكن أن ينصب في شكل اتفاق لاحق ويعني مشارطة التحكيم. | ||
