المستخلص: This article deals with the emergence of Islamic jurisprudence and its historical evolution, and how the emergence of jurisprudential Ijtihad since the Prophetic Age, and also dealt with the emergence of early jurisprudence schools in Hijaz and Iraq. These jurisprudence schools were the cause of the stability of the four doctrines of jurisprudence: Hanafi, Maliki, Shafi'i and Hanbali. This article also discusses the beginnings of the adoption of jurisprudential doctrines officially in the structures of the state, where the jurisprudential doctrine became a formal source of the three powers of governance: legislative, executive and judicial. There are many theoretical and systematic effects that have resulted from this phenomenon, such as the issue of combining the different schools of thought in one case, the composition of divergent jurisprudential views, and the issue of adopting jurisprudential statements based on ease and facilitation. Finally, this article dealt with the subject of sectarian intolerance, also addressed the issue of demanding the abolition of jurisprudential doctrines, resulted in this claim many negative effects and legislative chaos.
