المستخلص: سعت الجهات القضائية في كشف الجناة والمجرمين ومعاقبتهم، وإقامة العدل بين أفراد المجتمع، حيث انتدبت الخبراء والفنيين المتخصصين في كشف الجرائم، كخبراء التشريح في جرائم القتل، وخبراء البصمات والآثار في جرائم السرقة، وخبراء التقويم والتقدير في المنازعات العقارية... إلخ، ذلك أن القضاة لا يستطيعون الإحاطة بكل علم من العلوم، كعلم الطب والهندسة والكيمياء والزراعة والتحاليل الطبية المخبرية وغيرها. وكنتيجة حتمية لهذا التزاوج بين عمل القاضي بعمل الخبير، أصبحت الأحكام القضائية – من حيث الصحة والخطأ – مرهونة بعمل الخبير وكفاءته وإتقانه ونزاهته، الشيء الذي رفع قيمية الخبرة القضائية من حيث العناية بها علماً وعملاً وتقنيناً. لقد تناولت هذه الدراسة جانبا من جوانب العناية بالخبرة القضائية من حيث التأصيل الشرعي، فجمعت في طياتها مختلف أدلة مشروعية الخبرة القضائية من الكتاب والسنة وأقوال الفقهاء، كما ضبطت المواصفات الشرعية في الخبير النزيه الذي يعين القاضي في كشف الحقيقة ورد الاعتبار للمظلوم والأخذ على يد الظالم.

This study addressed the aspect of judicial experience care of in terms of rooting legitimate, were collected with it various evidence legitimacy of judicial experience of the Quran and Sunnah and sayings of scholars, also seized illegal specifications in honest expert appointed by the judge in uncovering the truth and rehabilitation of the oppressed and the introduction of the hand of the oppressor. The study was in accordance with the following plan: -Introduction: the circumstances of the subject and showed some of his subjects, with the introduction of the problematic. -First topic: the concept of judicial experience in forensic and legal language and terminology. -The second topic: the legitimacy of judicial experience. -The third topic: legitimate and legal expert in the conditions. -Conclusion; guaranteed the most important results obtained.
