المستخلص: تناولت الدراسة مبدأ الاعتبار الشخصي للمكلف في المعاملات المالية مع بيان أثر هذا المبدأ والتصرفات المالية للمكلف في الفقه الإسلامي. وأشملت الدراسة على مقدمة ذكرت فيها أسباب اختيار الموضوع وأهميته. وثلاث عناصر أساسية، وتناولت في الأول مفهوم الاعتبار الشخصي والتأصيل له، وفي الثاني أثر الاعتبار الشخصي للمكلف في المعاملات، وذكرت في الثالث أثر الاعتبار الشخصي في تصرفات المكره ومواقف الفقهاء من ذلك. وفي الأخير خاتمة ذكرت فيها أهم نتائج الدراسة، تليها مراجع البحث.

This research deals with studying the principle of personal consideration in transaction, it shows its impact on transaction and acts in Islamic Jurisprudence, I made the research constructed as an introduction and three researches: In the introduction, I included it with the reasons of selecting the subject, its importance and the scientific plan in which the research has followed. As regards to the first research, it included personal consideration in the contracts of an underage boy, in terms of defining his mental growth, its jurisprudential evidence, the positions of the scholars toward the contracts of an underage boy, behavior, and its indication of personal consideration with mentioning some applicable examples in this context. The second research has included the impact of personal consideration in inquisitive contracts; in terms of defining it, positions of the scholars toward its contracts and acts, its indications of personal consideration, with mentioning some applicable examples on it, also. The third research includes the impact of personal consideration on the acts of a forced individual, and I dealt with the definition of a forced individual, the positions of scholars toward its acts and its indication of personal consideration, with mentioning some jurisprudential applications. Then the conclusion, included the most important results of the research, then I indexed the resources of the research alphabetically, after that I ended the research with the confirmation of the subjects.
