المستخلص: الحكم الشرعي هو عمدة التكليف، إذ يشمل المكلفين ومن على شاكلتهم ممن لم يتوجه له الخطاب ابتداء، معروف أن الحكم الشرعي وينقسم قسمين هما: الحكم التكليفي وهو الأوامر والنواهي بأنواعه من إيجاب، وندب، وإباحة، وكراهة، وتحريم، والقسم الثاني: الحكم الوضعي بأنواعه من السبب والشرط والمانع وغير ذلك، فالخطابان يجمعهما أصل واحد وهو الحكم الشرعي، وقضية هذا البحث – إن شاء الله تعالى-هي بيان العلاقة بين الخطابين، مشفوعة بالتطبيق على الفروع الفقهية، إذ هي المقصود من الأصول والفروع، لكون الخطاب معتنيا بأفعال العباد وقد جاء هذا البحث مشتملا على مقدمة، ومبحثين، ومطالب، ومسائل، وخاتمة. الحكم الشرعي وأقسام الحكم التكليفي وأقسام الحكم الوضعي (الجعلي). والعلاقة بينهما والفروق بين خطاب التكليف، وخطاب الوضع. ودراسة تطبيقية، لحكم الحج أو العمرة من طريق البحر. وحكم سفر المرأة للحج بدون محرم. ومسائل أخرى وتضمن البحث عزو الآيات الكريمة لموضعها من الكتاب العزيز، وتخريج الأحاديث والآثار، والتعريف بالأعلام، وثبت المراجع، والموضوعات.
