|a تحتل التدابير الوقتية مكانة مهمة كإجراء من إجراءات الوقاية والاستعجال في القضاء الدولي، على غرار القضاء الوطني، وبالرغم من اختلاف الآراء الفقهية في تعريفها، إلا أنها تجد أساسها القانوني في مختلف الأنظمة الأساسية واللوائح الداخلية لهيئات القضاء الدولي، وتتميز هذه التدابير ببعض الخصائص فهي تدابير مؤقتة، وتسقط بمجرد صدور الحكم النهائي في النزاع، كما أنها قابلة للتعديل والإلغاء، وذات طبيعة استعجالية، ولا تمس موضوع النزاع. ويخضع طلب التدابير الوقتية لبعض الإجراءات والشكليات قبل وصوله للمحكمة، فيمكن تقديمه مع الطلب الأساسي في الدعوى أو في أي مرحلة من مراحل الدعوى، سواء كان كتابيا أو شفهيا وكذلك يمكن أن تلعب المحكمة دورا مهما في الأمر بالتدابير الوقتية من تلقاء نفسها إذا دعت الضرورة لذلك.

The request for provisional measures is subject to some procedures and formalities before reaching the court, so it can be submitted with the basic request in the case or at any stage of the case, whether in writing or verbally, as well as the court can play an important role in ordering the temporary measures on its own if necessary.
