المستخلص: شرع الصلح لرفع النزاع وقطع الخصومة التي ربما تورث العداوة، والعداوة – كما قيل – قليلها كثير. وقد نعت الله سبحانه الصلح بأنه خير بقوله تعالى﴿ وَالصُّلْحُ خَيْرٌ ﴾. والغاية من الصلح هي إبقاء أواصر المودة وحسن المعاملة بين المتنازعين. لأن فصل القضاء وما يتسم به من جبر وفرض قد يورث الضغائن والاحقاد بما لا تحمد عقباه، ولهذا كان سيدنا عمر بن الخطاب – رضي الله عنه – يقول: "رُدُّوا الخصوم حتى يصطلحوا، فإنَّ فَصلَ القضاء يورث بينهم الضغائن". هذا ولما كان النزاع سبب الفساد وكل شر، كان رفعه وقطعه بين الناس ومعاملاتهم مطلوباً شرعاً لأنه أي الصلح الوسيلة لذلك، والوسائل تأخذ حكم المقاصد. وبحسب ذلك سبباً لاختيار عقد الصلح عنواناً لهذا البحث.

Peace has begun to lift the dispute and cut off the rivalry that may inherit the enmity and hostility - as has been said - very few. Allaah has described peace as a good thing in the words of Allaah (peace and blessings of Allaah be upon him). The purpose of the reconciliation is to maintain the bonds of affection and good treatment between the disputants. Because the separation of the judiciary and its reparation and imposition may be inherited hatreds and hatred with undesirable consequences, and this was our master Omar ibn al-Khattab may Allah be pleased with him - says: "Respond to the opponents until they say, the separation of the judiciary will be inherited between them This is because the dispute is the cause of corruption and all evil, and lifting it and cutting it between people and their transactions is required by law because it is the means of doing so, and the means take the rule of the purposes. Accordingly, the reason for choosing the conciliation contract is the title of this research".
