المستخلص: الحمد لله الذي أباح لنا النظر في تنزيل النصوص، وأكرمنا بمضاعفة الأجر على الاجتهاد بالبحث عن الواقع الموصوف، والصلاة والسلام على من رفع الحرج عن أمته، وعلى آله وصحبه إلى يوم الدين. وبعد؛ فإن واقع العالم والأمم وعوائدهم، لا تدوم على وتيرة واحدة، ومنهج مستقر، إنما هو انتقال من حال إلى حال، واختلاف في الأزمنة والأيام، سنة الله التي قد خلت في عباده، وإن الشريعة الإسلامية إنما أنزلها الله تعالى لتعالج قضايا الإنسان الحادثة والمستجدة، كما أن النصوص التي أنزلها الله تعالى لها ارتباط وثيق بالواقع، فهو من يترجمها إلى أحكام عملية؛ لذا كان الواقع بأجزائه هو محور تنزيل النصوص الشرعية، وبه تظهر الأحكام الشرعية؛ لذا فقد اعتنى العلماء بالواقع وفهمه، ومعرفة تفاصيله؛ لأنه وعاء النصوص، لذا كان اختياري لهذا العنوان: [الواقع وأثره في تغير الفتوى] ليكون محور بحثي. أهمية البحث: تكمن في أنه يتعرض للفتوى وما هيتها، ويتعرض للواقع وماهيته، وكيفية تنزيل النصوص وفق الواقع مع مراعاة الثوابت الشرعية. • أسباب اختيار البحث: 1. الحاجة الماسة لمعرفة الواقع بتفاصيله، وتنزيل النصوص على وفقه. 2. وضع رؤية واضحة في التعامل مع الواقع، من خلال تنزيل النصوص على وفقه بما لا يتصادم مع ثوابت الشريعة. 3. دفع الشبه التي قد توهم الناظر لأول وهلة بوجود تعارض بين النصوص، بسبب تغير الحكم بتعدد الأشخاص. ونسأل الله تعلى القبول والإعانة، وأخر دعوانا أن الحمد لله رب العالمين.

The importance of research: It lies in that it is exposed to the fatwa and what it is, and exposed to reality and what it is, and how to download texts according to reality, taking into account the constants of legitimacy.
