المستخلص: مع انتشار وباء فيروس كورونا وتفشيه في العالم كله أحدث حالة من القلق بصورة دفعت الدول إلى اتخاذ جملة من الإجراءات التدبيرية والاحترازية في مكافحته والحد من انتشاره وأضراره، وصاحب ذلك موجة من الاختلافات وتعدد وجهات النظر في الموقف الشرعي إزاء كثير من القضايا، وجاءت هذه الدراسة للمشاركة في تجلية هذا الموضوع. وتهدف الدراسة إلى بيان جدوى التدابير التي أرشد إليها الإسلام لمكافحة الوباء والحد من انتشاره، وأنها صالحة لكل زمان ومكان، وتوضيح أثر القواعد الشرعية الفقهية والأصولية والمقاصدية في تحقيق أحسن التدابير الاحترازية في مواجهة الوباء، كما تهدف إلى الدعوة إلى الإفادة من هذه القواعد في حسن الاختيار للتدابير المناسبة. وسلك الباحث في دراسته هذه المنهج الاستقرائي والتحليلي من خلال تتبع القواعد الشرعية التي يمكن تفعيلها في باب الإجراءات الاحترازية في مواجهة الأوبئة، وتحليلها لمعرفة وجه الإفادة منها وتطبيقها. وخلصت الدراسة إلى جملة من النتائج، أهمها: 1- حرص الشريعة الإسلامية على صحة الإنسان من خلال ما أرشدت إليه من التدابير والتوجيهات سواء في الجانب الوقائي أو الجانب العلاجي. 2- أن القواعد الشرعية بفروعها الفقهية والأصولية والمقاصدية تؤيد كل إجراء أو تصرف من شأنه حماية النفس البشرية من الهلاك أو المرض. 3- الاسترشاد بالقواعد الشرعية يحقق أعلى المصلحتين ودرء شر الشرين على ضوء فقه الموازنات بالنظر إلى الحال والمآل. 4- ضرورة اتخاذ الإجراءات اللازمة وحسن التدبير في مواجهة الأوبئة، ووجوب ذلك على كافة مكونات المجتمع من الدولة والفرد وسائر التخصصات للمصلحة العامة ودفع شر مستطير يضر الجميع. وأوصت الدراسة بضرورة تكاتف كل الجهود، وتكاتف مختلف التخصصات في كل وقت لنهضة البلد، وفي الأزمات خاصة. وأكدت على أهمية العناية بالقطاع الصحي في كافة مجالاته واختصاصاته، وتطوير المنظومة الصحية لتلبية الاحتياجات العادية والاستثنائية.

The spread and outbreak of Coronavirus epidemic all over the world caused a state of concern in a way that led countries to take a serious of preventive and precautionary measures in controlling and limiting its spread and damages. This was accompanied by many differences and multiplicity of views on the Islamic Law position on many issues. This study came to participate in clarifying this topic. This aims at showing the feasibility of the measures that Islam has guided to control the epidemic and limit its spread, and that they are appropriate for every time and place, and to clarify the impact of Islamic Law jurisprudential, fundamental and purposesbased rules in achieving the best precautionary measures in confronting the epidemic. The study also aims to call for the benefit of these rules in good choice for appropriate measures. In this study, the researcher used the inductive and analytical approach through following Islamic Law rules that can be applied in the chapter of precautionary measures in confronting epidemics, and analyzing them in order to find out how to benefit from and apply them. The study concluded a series of findings, the most important of which are: 1- Islamic Law gave special care to human health through what it guided in terms of measures and directions, whether in the preventive or therapeutic aspect. 2- Islamic Law rules, with their jurisprudential, fundamental and purposes-based branches, support any action or procedures that would protect the human life from loss or illness. 3- Following Islamic Law rules achieve the best of both interests and prevent the worst of both bad things in the light of the Islamic jurisprudence of weightings in considering the situation and assets. 4- The need to take the necessary measures and good planning in confronting epidemics, and it is obligatory for all components of society from the State, the individual and all other disciplines for the public interest, and preventing a pure evil that harms everyone. The study recommended that all efforts should be made, and that the different disciplines should cooperate at all times for the renaissance of the country, especially in crises. The study emphasized the importance of taking care of the health sector in all fields and specializations, and developing the health system to meet regular and exceptional needs.
