المستخلص: The international discourse about women's rights has been divided into two currents, one of the is a moderate Islamic and the other is a secular Western supported by a global current under the auspices of the United Nations, and the latter has become more powerful since the beginning of the last century as a result of the issuance of several international conventions on women's rights, which have strict enforcement mechanisms to achieve its goals in the ratified states without any prevarication, and therefore these international conventions can be considered as a critical turning point in the consecration of women's rights at the international level, as it recognized the rights of women in all fields, and contributed in particular to promoting them within the family, because it considers that success in the fact that these rights exist in the laws of the countries of the world will greatly facilitate the consecration of other rights. These agreements, even if some consider them very positive in promoting women's rights at the international and national levels, but their gender implications that are based on equality, not gender justice, have made them more conflict instruments rather than they are rights instruments.

لقد انقسم الخطاب الدولي حول حقوق المرأة بين تيارين، أحدهما إسلامي معتدل والآخر علماني تغريي مدعوم بتيار عالمي تحت رعاية الأمم المتحدة، وقد أصبحت شوكة هذا الأخير أكثر قوة منذ بداية القرن الماضي نتيجة صدور عدة اتفاقيات دولية تعنى بحقوق المرأة، وهي ذات آليات تنفيذية صارمة لتحقيق أهدافها داخل الدول المصادقة عليها دون أي مراوغة، وعليه يمكن اعتبار هذه المواثيق الدولية منعرجا حاسما بل ونقطة تحول في تكريس حقوق المرأة على المستوى الدولي، حيث أقرت حقوقا للمرأة في جميع المجالات، بينما أسهبت خصوصا في تعزيزها داخل الأسرة. هذه الاتفاقيات وإن اعتبرها البعض جد ايجابية في تعزيز حقوق المرأة على المستوى الدولي والوطني إلا أن مضامينها الجندرية التي تبنى على المساواة لا العدالة بين الجنسين هي التي جعلت منها صكوك صراع أكثر من كونها صكوك حقوق.
