المستخلص: يساهم تقييد أو تعطيل العديد من حقوق الإنسان لضرورات الحفاظ على الصحة العامة في صون حقوق أخرى تعد أساسية مثل حق الإنسان في الحياة، وحقه في الصحة، فمثلا يساهم تقييد حق الإنسان في التنقل أثناء انتشار الوباء في حماية حق الإنسان في الصحة، ويعد تعطيل حق الإنسان في العمل عند حدوث كارثة حماية لحقه في الحياة، ويؤدي الانتقاص من حق الإنسان في أداء المناسك الدينية في حال سريان مرض معدي إلى صون حقه في الحياة وحقه في الصحة، ويجد هذا التقييد مشروعيته في العهد الدولي الخاص بالحقوق المدنية والسياسية، والعديد من الاتفاقيات الإقليمية المعنية بحقوق الإنسان، ويؤدي الفهم العميق لتكامل حقوق الإنسان وعدم قابليتها للتجزئة إلى وضع ضوابط للتدابير الاحترازية أو العلاجية التي تتخذها الدول في الحالات الاستثنائية للحفاظ على الصحة العامة، والتي تعطل أو تقيد العديد من تلك الحقوق، وهذه الضوابط يمكن أن تصاغ وفق خطة وطنية شاملة للحفاظ على الصحة العامة في بلد من البلدان، فلكل دولة خصوصية معينة في وضع سياستها وخطتها في الحفاظ على الصحة العامة، ولها اختيار ما يناسبها من إجراءات وتدابير في تصدي للحالات الاستثنائية التي تؤدي إلى المساس في الصحة العامة وذلك وفق ظروفها وإمكاناتها واحتياجاتها الخاصة، فلا يمكن تعميم تجربة أي دولة على الدول الأخرى في هذا المجال، وأي تعميم سيؤدي إلى انتهاك حقوق الإنسان لدواعي الحفاظ على الصحة العامة في غالب الأحوال.

Disruption or restriction any right of human rights can contribute to the necessities of maintaining public health in special cases in the protection of other fundamental rights as the human right in life and health. Restriction of human right, for example, in movement during epidemic break out is considered as a protection of human right in health. The violation of human right to work during a calamity is regarded as a protection for human right in life. The prevention of human right in performing religious rites during the spread of epidemic is considered as the protection of the right in life and health. The restriction is legally considered under the Special International Convention of Civil and Political rights and many other Human Rights regional agreements. The deep understanding of Human Rights will reveal its integrity and that it is indivisible, and this will lead to adopting controls of precautions or treatment measures which will be adopted by countries in special cases for maintaining public health, or the violation and restriction of many other rights. These controls may be worked out under a special national comprehensive plan for safeguarding the public health in a certain country. every state has its own certain specialty in setting forth its policies and plan for safeguarding public health, it also can choose the suitable measures and procedures in confronting the special cases that may affect public health in accordance with its conditions, possibilities and special needs. It is impossible to make the experience of any state applicable to another in this regard, in general, any application would be considered as violation of human rights on purpose of maintaining public health.
