يهدف البحث للتعرف على الأحكام الشرعية المستنبطة من الأدلة التفصيلية، ولأن الدين الإسلامي يحمل في طياته تبيان لكل حكم ولكل قانون لما اشتمل عليه من قوانين عامة ومبادئ كلية يمكن تحكيمها في كل ما يعرض للناس في كل زمان ومكان وفي كل الظروف والأحوال. والدستور الإسلامي هو الأمثل لحماية الحقوق والحريات في مختلف العصور إلى أن يرث الله الأرض ومن عليها. تتمثل مشكلة البحث في أن تطبيق شرع الله في الأرض يتوقف على فهم الأدلة الشرعية ودلالتها على معانيها فهما دقيقا لا شبهة فيه، وتفسير الأدلة الشرعية استناداً على فهم اللغة العربية بما يتفق مع مقاصد وروح الشرع، حتى لا يكون التشريع خاضعا للمصالح الفردية والأهواء الذاتية. كما نعلم أن العقول قاصرة وإدراكها متفاوتاً فقد يستحسن جماعة شيئاً ويستقبحه آخرون، بل إن الشخص الواحد قد يستحسن شيئاً في وقت ويستقبحه في وقت آخر، والإنسان مهما أوتي من قوة الملاحظة وسعة الإدراك عاجز عن الإحاطة بما تتطلبه الحاجات البشرية في حاضرها ومستقبلها لجهله بالغيب المستور. استخدم البحث المنهج التحليلي الاستنباطي ومعالجة مشكلة البحث بمنهجية علمية، والمنهج التاريخي. استرشاداً بما بين أيدينا من مصادر التشريع الإسلام.
The research aims to identify the legal rulings deduced from the detailed evidence, and because the Islamic religion carries within it an explanation of every ruling and every law that it contains of general laws and universal principles that can be arbitrated in all that is presented to people in every time and place and in all circumstances and conditions. The Islamic constitution is the best way to protect rights and freedoms in different eras until God inherits the earth and those on it. The problem of the research is that the application of the law of God on earth depends on an accurate understanding of the legal evidence and its connotations on its meanings, and the interpretation of the legal evidence based on an understanding of the Arabic language in accordance with the aims and spirit of the Sharia, so that the legislation is not subject to individual interests and personal whims. We also know that minds are deficient and their perceptions vary, so a group may approve of something and others ostracize it, but that one person may approve of something at one time and despise it at another time, and a person, regardless of the strength of observation and capacity for perception, is unable to comprehend what human needs require in their present and future because of his ignorance of the hidden absence. The research used the deductive analytical method and dealt with the research problem with a scientific method, and a historical method. Guided by what we have from the sources of Islam legislation.
