تتناول هذه الورقة مدى فاعلية المفاوضات في تسوية النزاعات الدولية، فنجد في كل المجتمعات البشرية أو التنظيمية أو الهيكلية بل في كل وسط اجتماعي، من الثابت أن أفضل وسيلة لحل أي نزاع هي تلك التي تقضي بأن يتم ذلك عن طريق الاتصال بين الأطراف أنفسهم، بشرط ألا يكون ذلك لغرض حقوق لا يملكها طرف معين أو لهضم حقوق الطرف الآخر أو طرف ثالث غائب عن عملية التفاوض. ذلك أنه لكي يكون هناك تفاوض لا بد من وجود شيء يتم التفاوض عليه ويدخل في سلطة أو اختصاص الأطراف ويخصهم. لذا كانت المفاوضات من أهم الوسائل الودية لتسوية النزاعات الدولية والتي أرقت العالم بأسره وعجزت كثير من الدول عن فض منازعاتها التجارية والأسرية بالطرق الرسمية للقضاء. من خلال هذه الورقة العلمية سنتعرف على ماهية المفاوضات وأنواعها وأدواتها ومن ثم دورها في فض النزاعات الدولية، برغم من وجود دراسات سابقة لحل الموضوع إلا أن الباحث سيقصر الموضوع من زاوية مختلفة وبمنظور متفرد لأجل إخراج عصارة علمية من خلالها يتأتى إبراز الأهمية العلمية والعملية للمفاوضات في حل النزاعات الدولية وسوف تأتي الدراسة على نحو فصلين.
This study deals with the effectiveness of negotiations in settling international disputes, so we find in all human, organizational or structural societies, but in every social milieu, it is proven that the best way to solve any conflict is that which requires that it be done through communication between the parties themselves, provided that it is not This is for the purpose of rights that a particular party does not possess, or to digest the rights of the other party or a third party absent from the negotiation process. That is, in order for there to be a negotiation, something must be negotiated and that enters into the authority or jurisdiction of the parties and pertains to them. Therefore, negotiations were among the most important amicable means of settling international disputes, which placated the world with a family, and many countries were unable to resolve their commercial and family disputes through official means of justice. Through this scientific paper, we will learn about the nature of negotiations, their types and tools, and then their role in resolving international disputes, despite the existence of previous studies resolving the issue, but the researcher will shorten the topic from a different angle and with a unique perspective in order to bring out a scientific juice through which the scientific and practical importance of negotiations will be highlighted in a solution. International conflicts and the study will come in about two chapters.
