تبنت الرؤية الوطنية للمملكة العربية السعودية دعم القطاع غير الربحي بعدد من الأدوات منها التبرع والوقف، وتعتبر حقوق الملكية الفكرية مصدرا مهما لبناء اقتصاد الدول لذلك خضعت للعديد من المراجعات القانونية لإصدار أنظمة تحمي حقوق أصحابها، والتبرع بهذه الحقوق أو وقفها يساهم في علاج كثير من القضايا المتعلقة بالصحة والتعليم والأبحاث، ساهم هذا البحث في بيان توافق طبيعة حقوق الملكية الفكرية مع شروط الوقف في الفقه الإسلامي. اشتراط التأبيد في الموقوف عليه ليس له أثر، لأن الحق الفكري يؤول إلى الملك العام وليس على صاحبه، لذا يصح وقف حقوق الملكية الفكرية وإن كانت مؤقتة، فتبين توافق طبيعة حقوق الملكية الفكرية مع الشروط الواردة في الوقف إذا كان هذا الحق الفكري مالا متقوما، معلوما، مملوكا للواقف ملكا تاما، حتى وإن كان مؤقتا أو منقولا.
