المستخلص: إن مما لا شك فيه أن ديننا كله مبني على جلب المصالح، ودفع المفاسد، وإن المصلحة هي المحافظة على مقصود الشرع، وهناك أنواع من المصلحة منها المعتبرة، ومنها الملغاة، ومنها المسكوت عنها، وهذه محل خلاف بين العلماء، ولا يمكن لكل شخص أن يفتي بوجوب العمل بالمصلحة، حسب تشهيه وهواه، لذا وضع العلماء للعمل بالمصلحة ضوابط لا بد من توفرها، وهي:) ملائمتها لمقاصد الشارع، وأن يكون العمل بها في غير الأمور التعبدية، وأن تكون معقولة بذاتها، وأن تكون حقيقية لا وهمية، وأن تكون عامة لا خاصة، وأن لا يفوت خلال العمل بها مصلحة أهم، أو مساوية لها، وخلال بحثي الموسوم) العمل بالمصلحة للمرجوح (وجدت أن جماهير العلماء القدامى والمعاصرين قالوا: بوجوب العمل بالقول الراجح، وبعض العلماء وهم قلة، وقد ذكرتهم في بحثي قالوا: بجواز العمل بالقول المرجوح، إذا كان فيه مصلحة للناس، أو للضرورة وغيرها، وذكروا للعمل بالمرجوح شروطاً منها: )أن لا يخالف القول المرجوح الكتاب والسنة، وأن يكون الذي قال به من أهل الاجتهاد، وأن يكون لسبب وهو: تغير الأعراف، والأزمنة، والأمكنة، ورفع الحرج عن الناس، وصلى الله على سيدنا محمد وعلى اله وصحبه وسلم.

There is no doubt that our entire religion is based on bringing interests and warding off evil, and that the interest is preserving the intent of the Sharia, and there are various types of interest, some of which are considered, and some are canceled, and some of them are silent, and this is a matter of dispute among scholars, and not every person can issue fatwas. It is imperative to work with the interest, according to his desires and whims, so the scholars have set regulations to work in the interest that must be met, which are: (They are compatible with the purposes of the street, that they work in matters other than worship, that they are reasonable in their own right, that they are real and not fake, and that they are public and not private And that he does not miss a more important interest, or equal to it, and during my research marked (working with the interest for the benefit) I found that the masses of ancient and contemporary scholars said: It is necessary to act with the correct saying, and some scholars who are few, and I mentioned them in my research they said: It is permissible to work with the correct saying If it is in the interest of the people, or for necessity, etc., and they mention conditions for the action that are more likely: (That the correct saying does not contradict the Qur’an and the Sunnah, and that what he said is among the people of diligence, and that it is for a reason: the change of norms, times, places, and the removal of embarrassment from People, may God bless our master Muhammad and his family and companions.
