In this study, we tried to extract the legal basis in which the presidential administrative authorities, the Administrative Prosecution, and the technical inspection department of the legal department establish its mandate to conduct a disciplinary investigation in respect of members and managers of the legal department, and determine the scope of this jurisdiction for each of these entities, and also we had clarified the controls of conducting the disciplinary investigations in front of these bodies with members and managers of this category. In addition we also reviewed the disposition of the above mentioned bodies in these disciplinary investigations, as well as to clarify the Supreme Administrative Court’s position of the consequences resulting by virtue of this multiplicity and overlap on the jurisdiction concerning the disciplinary investigation with members and managers of the legal departments, and we tried to reconcile as soon as possible between these various deferring juridical reviews. |
