Fundamentally, the uniform application of law involves the requirements of legal certainty based, inter alia, on the principle of equality, which embodies another major constituent element of the unity of law in the same territory. This is a permanent search for a certain degree of unity of law which could only be guaranteed by a central unifying structure for the law. The purpose of this contribution is to put into perspective the manifestations of the unity of law in the Moroccan legal system and its consequences on the protection of legal certainty. It is, first of all, to examine how the normative unity of the State operates in the territory and the legal area as well as its contribution to the protection of the requirement of legal certainty intrinsically linked to respect for the constitutional principle of equality of citizens before the law, and second, to study the limitations that may prejudice this objective. Fondamentalement, l’application uniforme du droit participe des exigences de la sécurité juridique basées, entre autres, sur le principe de l’égalité, qui incarne un autre élément majeur constitutif de l’unité du droit sur le même territoire. Il s’agit d’une recherche permanente d’un certain degré d’unité de droit qui ne pourrait être garantie que par une structure centrale unificatrice pour le droit. L’objet de la présente contribution est de mettre en perspective les manifestations de l’unité de droit dans le système juridique marocain et ses conséquences sur la protection de la sécurité juridique. il s’agit, dans un premier temps, d’examiner comment s’opère l’unité normative de l’Etat dans le territoire et l’espace juridique ainsi que son apport à la protection de l’exigence de sécurité juridique intrinsèquement liée au respect du principe constitutionnel de l’égalité des citoyens devant la loi, et dans un second temps, d’étudier les limitations susceptibles de porter préjudice à cet objectif. |
