Through outa reading of the Moroccan antiterrorist legislation of the year 2003, it appears that it includes restrictions on the elementary rights of the defendants, it’s quite necessary to perceive a stable and global action in dealing with antiterrorism and humain rights issues as well. Certainly, then, the fight against terror is me shouldbehandled with respect to the fundamental rights of the accuse din cluding the right to a trial and a fair judge ment. Thus, the security right and the specific caracter of the terrorist threat should not justify the violation of the fundamental rights, it’s quit necessary to improve legal legislation in Moroccan antiterrorist in order to preserve the role of leurs principles. A travers une lecture de la législation marocaine antiterroriste de 2003, il ressort qu’elle contient des restrictions aux droits fondamentaux des inculpés, d’où la nécessité de concevoir une action globale et équilibrée pour le traitement des questions de lutte antiterroriste, et des droits de l’Homme. Il est certain que la lutte contre le terrorisme doit être menée dans le cadre du respect des droits fondamentaux de l’inculpé y compris le droit à un procès et un jugement équitable. Partant, le droit à la sécurité et le caractère spécifique de la menace terroriste ne doivent pas justifier les atteintes aux droits fondamentaux, d’où l’exigence d’une réforme de la législation juridique marocaine de lutte antiterroriste pour préserver les principes de l'Etat de droit. |
