إن الاعتراف بحقوق الإنسان والدفاع عنها تعد من الواجبات الأساسية للمجتمع، وقد أكد عليها الإسلام والرسول الكريم صلى الله عليه وسلم، والإمام علي عليه السلام، لما لمسوه من ظلم وقهر لمجتمع الجزيرة العربية قبل الإسلام، وقد عمدوا على نصرة الإنسان وإرساء قواعد حقوق الإنسان، ولم يقتصر ذلك على البالغين من الرجال والنساء بل شمل ذلك الأطفال أيضاً، لقد عامل المجتمع العربي قبل الإسلام الأطفال من الإناث خصوصا معاملة قاسية لا تمت للإنسانية بصلة، عندما اغتصبوا حق حياة الإناث المولودة حديثا، وقد شخص القرآن الكريم ذلك قال تعالى: (وَلَا تَقْتُلُوا أَوْلَادَكُمْ مِنْ إِمْلَاقٍ نَحْنُ نَرْزُقُكُمْ وَإِيَّاهُمْ) الأنعام: ١٥١، لذلك حرص الرسول الكريم صلى الله عليه وآله وسلم على الحفاظ على حياة الأطفال، كما أخذ الإمام علي عليه السلام على عاتقه حث المؤسسات الحكومية للخلافة الراشدة والمسلمين باحترام حقوق الأطفال وفق الآداب العامة والقوانين الإسلامية، الغرض منها تنشئة الأطفال تنشئة إسلامية صحيحة وزرع الثقة في نفوسهم، وبناء مجتمع إسلامي متماسك يسوده العدل والمساواة، لذا لم يتوانى الإمام عليه السلام بالدفاع عن حقوقهم أمام الخلفاء الذين سبقوه، حتى أرسى قواعد حقوق الأطفال في حكومته من خلال الحِكم والأقوال التي زخر بها كتاب نهج البلاغة وغيره من الكتب التي عنيت بذلك، أما في العصر الحديث ونتيجة للحروب والانتهاكات التي حدثت في القرون السابقة والقرون الحالية، وبالأخص ما حصل في الحربين العالميتين الأولى والثانية من انتهاكات لحقوق الإنسان عامة وحقوق الأطفال خاصة في استخدامهم في الحروب، وقصف المدن بالقنابل المحرمة في بعض الأحيان مما يتسبب في إزهاق أرواحهم، أو استخدامهم في العمالة الرخيصة وحرمانهم من الرعاية الصحية والتعليم وغيرها من الخروقات التي تعرض لها الطفل، دفعت منظمة الأمم المتحدة لاتخاذ الخطوات اللازمة لتأمين حقوق الطفل من خلال وضع اتفاقية حقوق الأطفال، التي وقعت عليها معظم بلدان العالم، إن عدم إلمام البعض عن أهمية موضوع حقوق الأطفال جعلتني أبحث في هذا الموضوع المهم، وقد استعنت بمصادر الكتب التاريخية والفقهية ومراجع أخرى تناولت الموضوع من جانب إسلامي وأخرى من جانب عصري من خلال سرد اتفاقية الطفل في الأمم المتحدة. ومن الله التوفيق.

Al-An’am: 151, so the honorable Messenger ول was keen on preserving the lives of children, just as Imam Ali took it upon himself to urge governmental institutions for the rightly guided caliphate and Muslims to respect the rights of children in accordance with public morals and Islamic laws, the purpose of which is to bring up children a correct Islamic upbringing and instill confidence In their hearts, and building a cohesive Islamic society dominated by justice and equality, so the Imam did not hesitate to defend their rights before the caliphs who preceded him, until he laid the foundations for the rights of children in his government through wisdom. The sayings in which the book Nahj al- Balagha and other books were rich in it, either in the modern era and as a result of the wars and violations that occurred in previous and current centuries, especially what happened in the first and second world wars in terms of violations of human rights in general and the rights of children, especially in their use in wars And the bombing of cities with forbidden bombs at times, causing the loss of their lives, or using them in cheap labor and depriving them of health care, education and other violations against the child, prompted the United Nations to take the necessary steps to secure the rights of the child through the establishment of the Convention on the Rights of Children, which Most countries of the world signed it, because some people were not aware of the importance of the issue of children’s rights, which made me research this important topic.
