المستخلص: عمد المشرع الجزائري كغيره من المشرعين في معظم الدول إلى الاهتمام بحماية المستهلك وتوفير الإطار الملائم لضمان سلامته وأمنه من المخاطر التي قد تواجهه، فعمل على توفير حماية فعالة للمستهلك وأوجد بذلك وسائل خاصة يضمن له الحصول على المنتوجات والخدمات التي تلبي رغباته المشروعة، ومن أجل تحقيق هذه الحماية أنشأ المشرع الجزائري أجهزة تراقب مدى سلامتها وتأهيلها للاستعمال ومدى مطابقتها للمقاييس المعتمدة والمواصفات القانونية والتنظيمية. توصلت الدراسة إلى أنه تعتبر وزارة التجارة الجهة الرسمية المكلفة بحماية المستهلك في الجزائر بما تحتويه من هياكل مركزية ومصالح متخصصة بالإضافة إلى المصالح الإدارية المحلية، حيث يكون لها دور كبير في تطبيق قواعد ومبادئ القوانين المنظمة لحماية المستهلك، ورغم جهود الدولة المبذولة في هذا الخصوص إلا أنها تبقى دائما بحاجة إلى تفعيل نشاط الأجهزة الإدارية وتحديث الوسائل المعتمدة للقيام بعملية الرقابة.

The Algerian legislator, like other legislators in most countries, has ensured the protection of consumers and to provide an appropriate framework to ensure their safety and security against the risks they may face, thus ensuring effective protection for consumers and creating special means to ensure that they have access to products and services that meet their legitimate desires, and to achieve these protections. The Algerian legislator has set up bodies to control their safety and their qualifcation for use and their compliance with approved standards and legal and regulatory specifications. The study revealed that the Ministry of Trade is considered the official body in charge of consumer protection in Algeria, with its centralized structures and specialized interests, in addition to local administrative interests, where it plays a major role in the application of the rules and principles of consumer protection laws, and despite the efforts of the State in this regard, it must always activate the administrative bodies and update the means adopted to carry out the control process.
