This study attempts to answer the following main question: (What is the concept of matching in different places, what is its place of action in the evidence, and what are its designations among fundamentalists, and what is the effect of matching with different place between conflicting evidence in purity, prayer?). Therefore, the nature of the study required that it come in three sections, for each topic its demands, and the introductory topic included the concept of conflict and the matching of evidence, and in the first topic the researcher dealt with the concept of the difference in the place, the place of its work in the evidence, its designations among the fundamentalists, and the difference between place and the difference of the situation, Then he mentioned in the second topic the effect of gathering according to the place of difference in matching evidence in purity and prayer. Finally, this study concluded with the most important results that I have reached, including: that the difference in the place is the matching of the two opposing directories, apparently by carrying each of them to a place or case that differs from the other, so the conflict is pushed and the two texts are worked in each of its places, including also the requirement of the union of the place to increase clarification and clarity on what It is the owners of the matter in the matter of contradiction, because it is often motivated to weight the difference in the place, including that it matching evidence with "difference in place" in the event of two general texts in general at all, or in particular at all, and from the results that the fundamentalists expressed the concept of (difference in place) with labels different, Some of them express the (difference of the place), others pass with (the difference of the situation), some of them differentiate between them and sometimes cross with the difference in the place and sometimes with the difference in the situation, and some express in other terms for the concept of different place such as distribution and whitening (and sharing and distribution) and diversification, and there is no fundamental difference on which nothing is based upon Fundamentalists between the expression according to the different assignments and the different situation, because their performance is the same, and it carries every evidence of a location that differs from the other, so that the conflict is negated and there is matching between the legal evidence.
تحاول هذه الدراسة الإجابة عن السؤال الرئيس الآتي: (ما مفهوم الجمع باختلاف المحل، وما موضع إعماله في الأدلة، وما تسمياته عند الأصوليين، وما أثر الجمع باختلاف المحل بين الأدلة المتعارضة في الطهارة والصلاة؟). لذلك اقتضت طبيعة الدراسة أن تأتي في ثلاثة مباحث، لكل مبحث مطالبه، وقد اشتمل المبحث التمهيدي على مفهوم التعارض والجمع بين الأدلة، وفي المبحث الأول تناول الباحث مفهوم اختلاف المحل، وموضع إعماله في الأدلة، وتسمياته عند الأصوليين، والفرق بين اختلاف المحل واختلاف الحال، ثم ذكر في المبحث الثاني أثر الجمع باختلاف المحل في الجمع بين الأدلة في الطهارة والصلاة. وأخيراً ختمت هذه الدراسة بأهم النتائج التي توصلت إليها، ومنها: أن اختلاف المحل هو الجمع بين الدليلين المتعارضين ظاهراً بحمل كل منهما على محل أو حال يختلف عن الآخر، فيندفع التعارض ويعمل بالنصين كل في محله، ومن النتائج أيضاً اشتراط اتحاد المحل زيادة توضيح وتنصيص على ما هو ملاك الأمر في باب التناقض، فإنه كثيراً ما يندفع الترجيح باختلاف المحل، ومنها أنه يجمع بين الأدلة ب "اختلاف المحل" في حال ورود نصين عامين عموماً مطلقاً، أو خاصين خصوصاً مطلقاً، ومن النتائج أن الأصوليين عبروا عن مفهوم (اختلاف المحل) بتسميات مختلفة، فبعضهم يعبر ب(اختلاف المحل)، والبعض يعبر ب(اختلاف الحال)، وبعضهم يفرق بينهما، ويعبر أحياناً باختلاف المحل، وأحياناً باختلاف الحال، وبعضهم يعبر بمصطلحات أخرى لمفهوم اختلاف المحل، كالتوزيع، والتبعيض (والاشتراك، والتوزيع)، والتنويع، ولا يوجد فرق جوهري ينبني عليه شيء عند الأصوليين بين التعبير باختلاف المحال واختلاف الحال؛ لأن مؤداهما واحد، وهو حمل كل دليل على موضع يختلف عن الآخر بحيث ينتفي التعارض، ويحصل التوافق بين الأدلة الشرعية.
