راعت الشريعة الإسلامية أحوال الناس جميعها، وخففت التكليف عن أصحاب الأعذار، ومنهم المسافر. وقد تناولت في بحثي هذا بعض أحكام السفر، وقسمت البحث إلى مقدمة، وثلاث مباحث، وخاتمة، كما يلي: المقدمة وتشتمل على إيضاح موضوع البحث وأسباب اختيار الموضوع وأهميته والدراسات السابقة، ومنهج الكتابة فيه، ثم خطة البحث. ثم المبحث الأول، وفيه مطلبان، الأول: تعريف السفر، والمطلب الثاني بيان مقدار السفر الذي يشرع فيه القصر. والمبحث الثاني وفيه مطلبان، المطلب الأول في حكم الجمع بين الصلاتين تقديما وتأخيرا، المطلب الثاني هل يشترط في الجمع الجد في السير. وأخيرا المبحث الثالث وفيه ثلاثة مطالب، الأول: دليل المسح على الخفين، الثاني: في مدته، الثالث: في شروط المسح على الخفين ونواقضه. وقد خلص البحث إلى عدة نتائج منها: أن القصر رخصة وليس عزيمة. وأن الراجح -والله أعلم- أن السفر غير مقدر بمدة، وأن الأحكام تبنى على ما يسمى سفرا عرفا. وأنه يجوز الجمع للمسافر سواء تقديم أو تأخير. وأن المسح على الخفين مقدر بمدة للمقيم يوم وليلة وللمسافر ثلاث أيام بلياليها.
Islamic law took into account the conditions of all people, and reduced the commission on those who had excuses, including the traveler. I have dealt with in my research some of the travel provisions and divided the research into an introduction, three sections, and a conclusion, as follows. The introduction includes clarification of the research topic, the reasons for choosing it and its importance, previous studies, the methodology of writing it, then the research plan. The first topic, it has two requirements. The first one is the definition of travel. The second requirement is to indicate the amount of travel that are permitted to undertake. The second topic contains two requirements, the first one is the rule of combining the two prayers, by advancing or delaying them. The second requirement if it is a condition for combining to travel with out stopping. Finally the third topic has three demands. The first requirement is the evidence of wiping over the socks. The second requirement is its period. The third requirement is the terms of Wiping over the socks and their breaks. The research concluded several results. The limittion of prayers is a permission not original ruling. The most correct thing, and God knows best, that travel is not estimated by a specific period and that the rulles are based on what is called, by custom, travelling. The permission for combining prayers by advancing or delaying them. Wiping over the socks is estimated by a period of time. For the residents, one day and one night, and for the traveller three days and three nights.
